Re: Acquisition of 10.61 acres in Pa'o'o, North Kohala, Island of Hawaii;

The Hawaii County Public Access, Open Space and Natural Resources Preservation
Commission cited Pa'o'o as a site where there are "Lands or property entitlements with high
public interest, imminent needs for acquisition, and largest benefit to the general public."
Resolution No. 616 -08, passed by the County Council on May 7, 2008, authorized the Director
of Finance to enter into negotiations for acquisition of the subject parcel collectively known as
Pa'o'o.
On September 19, 2009, the County of Hawai'i, applied for funding by grant from the State of
Hawai'i, Department of Land and Natural Resources, Legacy Land Conservation Commission,
for the acquisition of Pa'o'o. The Legacy Land Conservation Commission approved the
County's application and granted the amount of $945,000, which the Board of Land and
Natural Resources approved on March 11, 2010.
Enclosed is a resolution authorizing the Mayor to enter into an agreement with the State of
Hawai'i, Department of Land and Natural Resources, Legacy Land Conservation Commission
and to accept funds for the acquisition of Pa'o'o, District of North Kohala, Island of Hawai'i.
Since the funds must be encumbered by the State on or before June 30, 2010, the
Department of Finance is requesting a waiver from the Finance Committee and to have this
resolution heard at the next Council meeting scheduled for May 19, 2010.

A. REQUEST:
Prepare resolution authorizing the Mayor to enter into an agreement with the State of Hawaii, Department.
of Land and Natural Resources, Legacy Lands Conservation Commission to accept funds for the
acquisition of Pa'o'o.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The County of Hawai'i applied for grant funding from the State of Hawai'i, Department of Land
and Natural Resources, Legacy Land Conservation Commission for the acquisition of Pa'o'o on
September 10, 2009. The State of Hawaii, Board of Land and Natural Resources approved the
Legacy Land Conservation Commission's grant of $945,000.00 to the County of Hawaii. The Board
of Land and Natural Resources must encumber these funds on or before June 30, 2010.
Since the BLNR needs to encumber these funds before June 30, 2010, we humbly ask that we waive the
Finance committee, and have this resolution heard at the Council Meeting scheduled for May 19, 2010.

RE: Resolution No. 338 -10 : Resolution Authorizing the Mayor to Enter into an
Agreement With the State of Hawai`i Department of Land and Natural Resources, Legacy
Land Conservation Commission, and to Accept Funds for the Acquisition of Pa`o`o, North
Kohala, Hawaii
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above - referenced matter be
waived from the Finance Committee to the full Council for immediate action. In reviewing this
matter, timely approval is crucial. It is therefore advantageous that approval is granted and the
matter be placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Finance Committee
for placement on its future agenda.
