The Office of the Corporation Counsel, the Office of the Mayor, The Hawaii County Police Commission and the Administration of the Hawaii County Police Department, have conspired and continue to conspire to violate the civil rights of the citizens of Hawaii County through the misuse of official powers, extreme violations of the state "Sunshine Law ", and official intimidation of citizens. We have a County Government which chooses as a matter of course to govern by the principle of doing whatever they can get away with, with the intention that if no one calls them on it they will get away. That attitude is more to be expected of used car salesmen than of sworn public servants. With the County Corporation Counsel acting as the linchpin for the corruption which we see here, citizens have little option short of expending large amounts of their own money for expensive litigation, money most of us don't possess, to try to get our government to act lawfully. We are loathe to have to keep apologizing to our friends, our relatives and other visitors to Hawaii for the political corruption which is often evident to even casual tourists. It has been said that people get the govelrnment which they deserve. The good people of the Big Island don't deserve a government which ignores the rule of law, which ignores the rights of its citizens and which ignores the fact that while our sense of dignity can ignore the most oppressive despot, that dignity can be crushed by the despotism of law. When people's dignity is crushed by law they have no hope but from power. If the law is their enemy, they will be enemy to the law. (Our apologies to Edmund Burke). We ask that you would immediately: 1. Require the State Attorney General to file a Quo Warranto suit against Stephen Yamashiro for violation of 78 -6 HRS. Such a suit S.P. No.96 -061 is currently pending against Yamashiro in the Third Circuit Court (Judge Greg Nakamura). Former Attorney General Margery Bronster issued an informal opinion that Yamashiro is responsible under the Statute. If she was correct, then Yamashiro is a usurper. 2. Ask the State Office of Disciplinary Counsel to immediately investigate Assistant Corporation Counsel Ted Hong for the following ethical violations: First that he has issued opinions to the Hawaii County Police Commission concerning their legal responsibilities in investigating wrongdoing by Wayne G. Date • • Carvalho as Police Chief, while representing himself to no Tess than the Attorney General of the United States as legal counsel for Carvalho. Secondly that he has failed.to follow the order of the judge in the above named court action, S.P. No. 96 -061, by failing to file a final judgement as ordered by that judge. Thirdly, that he has lied to the Attorney General of the United States by grossly misstating the actions of the Hawaii County Council in order to obtain an opinion favorable to his client. 3. Appoint a commission to review all personnel actions taken by the Hawaii County Police Department under Wayne G.. Carvalho for legality, fairness and propriety, and to review all Police Commission actions for the past two years for legality. 4. immediately ask the State Attorney General to investigate the actions of Police Chief Wayne Carvalho, Deputy Chief James Correa, Assistant Chiefs Lawrence Mahuna and Thomas Hickcox and Sgt. Hyland Char, for misusing their police powers to violate the civil rights of Officer Tanny Cazimero. Please attend to our petition soon, as our patience with and trust in official remedies has worn thin. Thank You.
