STATE OF HAWAII
RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A MEMORANDUM OF
AGREEMENT WITH STATE OF HAWAII STATE CIVIL DEFENSE TO PROVIDE
FUNDING RELATED TO TSUNAMI WARNINGS.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, the County of Hawai`i recognizes the critical importance of tsunami
warning and information; and
WHEREAS, State of Hawai`i, State Civil Defense, hereinafter "State Civil Defense" and
the County of Hawai`i Civil Defense Agency, hereinafter "CDA ", in recognition of the
importance of tsunami warning and information, seek to collaborate on a project to further
identify and mark Tsunami Evacuation Zones on the island of Hawai`i through the proposed
Memorandum of Agreement (see Exhibit A attached hereto); and
WHEREAS, the memorandum of agreement proposes that the State Civil Defense will
provide up to $20,000.00 to CDA to purchase markers and signs to identify Tsunami Evacuation
Zones; and
WHEREAS, pursuant to Hawai`i Revised Statutes (HRS) Section 46 -7, the Hawai`i
County Council may consent to agreements between the County and the State government
respecting action to be taken pursuant to the powers granted to the County by law and to furnish,
expend, and receive any funds or other assistance in connection with projects to be undertaken
by the County.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with HRS Section 46 -7, that the Mayor of the County of Hawai`i is
authorized to execute, on behalf of the County, the Memorandum of Agreement with the Civil
Defense Division, Department of Defense, State of Hawai`i (see Exhibit A attached hereto) to
enable the County to formalize its collaboration with State Civil Defense in the Tsunami
Evacuation Zone identification and marking processes.
BE IT ALSO RESOLVED that a copy of this resolution be forwarded to: (1) Mayor
William P. Kenoi; (2) the Civil Defense Agency; (3) Deputy Corporation Counsel Craig T.
Masuda; and (4) Ed Teixeira, Vice Director, Hawai'i State Civil Defense, 3949 Diamond Head
Road, Honolulu, HI 96816 -4495.

MEMORANDUM OF AGREEMENT
Between
CIVIL DEFENSE DIVISION
DEPARTMENT OF DEFENSE
STATE OF HAWAII
and the
HAWAII COUNTY CIVIL DEFENSE AGENCY
This MEMORANDUM OF AGREEMENT (MOA), made on this day of
, 2010, is entered into by the STATE OF HAWAII, DEPARTMENT
OF DEFENSE, Civil Defense Division (Sponsor) and the HAWAII COUNTY CIVIL
DEFENSE AGENCY, and witness that:
1. This MOA is for the purpose of the signage project entitled "Tsunami Evacuation
Zone Intersection Markers" to be conducted by the HAWAII COUNTY CIVIL
DEFENSE AGENCY.
2. Period of Performance. This MOA shall be effective from May 01, 2010 to July 31,
2010.
3. Modifications. Any modifications or changes to the terms or provisions, other than
for transfers among budget categories, to this Agreement shall be made only by
written amendment to this agreement, signed by the authorized signatories of the
Sponsor and the Hawai`i County Civil Defense Agency.
4. Project Budget. The Hawai`i County Civil Defense Agency shall perform this
Agreement in accordance with the budget and scope detailed in its Tsunami
Evacuation Zone Intersection Markers proposal to the Sponsor which is incorporated
herein by reference. Funds may be transferred among budget categories provided the
intended purposes of the Agreement are carried out and that the total expenditures do
not exceed the amount of $20,000.00.
5. Method of Payment. The Sponsor shall reimburse the Hawai`i County Civil Defense
Agency for services rendered upon receipt of original invoice with supporting
documentation from Hawai`i County. If other payment arrangements for costs
incurred as a result of this MOA are desired, agreement must be reached after
consultation between the fiscal offices of the STATE and Hawai`i County Civil
Defense Agency. Funding for the Tsunami Observer Program is authorized by:

6. Quarterly Reports. The Hawai`i County Civil Defense Agency shall provide a final
project report after completion of the project.
7. Termination. This Agreement may be terminated by either party by giving thirty
(30) days written notice. Upon early termination of the Agreement, the Hawai`i
County Civil Defense Agency shall submit an accounting of the work performed to the
Department of Defense, State Civil Defense, up to the date of termination within thirty
(30) days. Sponsor shall pay to the Hawai`i County Civil Defense Agency the sum
equal to the actual cost of the acceptable services rendered to date of termination and
for any non - cancelable commitments, provided the sum does not exceed the total of
$20,000.00.
IN WITNESS THEREOF, the parties have executed this MEMORANDUM OF
AGREEMENT on the day, month and year mentioned above.
