STATE OF HAWAII r Mr RESOLUTION NO. 348 10 A RESOLUTION TO SET A POLICY FOR THE FISCAL YEARS 2010 -11 AND 2011- 2012 TO PROHIBIT HIRING RETIRED COUNTY EMPLOYEES FOR SHORT -TERM EMPLOYMENT CONTRACTS, EXEMPTING CERTAIN DEPARTMENTS AND EMPLOYEES. WHEREAS, the County of Hawai`i is in a serious economic dilemma due to the national and international financial downturn; and WHEREAS, it is no longer appropriate to rehire retired County employees on short-term contracts to train other remaining employees to do the work from which they just retired, or to fill vacancies; and WHEREAS, overtime budgets will probably be reduced and funds will not be available to pay the salaries of many short-term contact employees; and WHEREAS, most of our employees are taking.a two - day - per -month furlough, and it would be egregious and in bad faith to hire contract employees while our own employees are required to take furloughs or salary decreases or delay their pay increases; and WHEREAS, those departments and employees protecting public health, safety, and welfare; employees hired by the Department of Parks and Recreation to cover the school intercessions, summer sessions, and any elder activities or programs; any interns hired to assist the Office of the Corporation Counsel and the Office of the Prosecuting Attorney; the Medical Director for the Hawai`i Fire Department; and the Office of the Legislative Auditor shall be exempted from this policy if they are paid by the County; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the policy for the next two fiscal years (FY 2010 -11 and FY 2011 -12) shall be to prohibit the hiring of retired County employees on a short-term contract basis with the exception of (1) those departments and employees protecting public health, safety, and welfare; (2) employees hired by the Department of Parks and Recreation to cover the school intercessions, summer sessions, and any elder activities or programs; (3) any interns hired to assist the Office of the Corporation Counsel and the Office of the Prosecuting Attorney; (4) the Medical Director for the Fire Department; and (5) the Office of the Legislative Auditor. BE IT FURTHER RESOLVED that this policy shall not apply to positions paid for by grants from any source other than the County. BE IT FURTHER RESOLVED that any contract entered in violation of this policy shall be void. BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this Resolution to the Honorable Mayor William Kenoi and the director, head, and administrator of each department, office, and agency of the County of Hawai`i.
