BILL NO. 187 ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 3, SECTION 3 -31, PROHIBITED SIGNS, OF THE HAWAII COUNTY CODE, BY ADDING A NEW SUBSECTION PROHIBITING SIGN WAVING. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: Section 1. Findings and Purpose. It is the intent of recent legislation regarding roadside vending to eliminate potential sources of County liability for traffic accidents which may arise out of roadside activity. Considering all the accidents and near misses created by "sign waving" along the roads, the Council finds that to protect the public and eliminate potential County liability, sign waving should be prohibited. Section 2. Chapter 3, Section 3 -31 of the Hawaii County Code 1983, relating to prohibited signs, is amended by adding a new subsection to be appropriately numbered and to read as follows: ( ) No person shall hold signs within 500 feet of any intersection and wave at passing motorists thereby constituting a traffic hazard by diverting or tending to divert the attention of drivers of moving vehicles from the traffic movement on the public streets and roads. SECTION 3. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
