AN ORDINANCE RELATING TO WAIPIO VALLEY ACCESS ROAD
Be it Ordained by the Council of the County of Hawaii
SECTION 1. Purpose - The Council finds that the width, curves and grade of the
Waipio Valley Access Road between the Waipio Valley Lookout and the valley floor makes the road
unsuitable for certain large vehicles or those vehicles not equipped with all wheel drive.
SECTION 2. Chapter 24 of the Hawaii County Code (1995 edition), as
amended, is hereby further amended by adding a new Article to be appropriately numbered and to
read as follows:
ARTICLE
Waipio Valley Access Road
SECTION 24 - .1 Definitions - For the purposes of this article. unless
otherwise indicated. the following definitions shall apply:
"Large Capacity Passenger Vehicles" means aqy motor vehicl w ith a veh icle
weight. as indicated on the vehicles certificate of registration. in excess of 15.000
pounds and which is designed. constructed. and used pnmarily for the carriage of
passengers.
"All Wheel Drive Vehicle" means any motor vehicle in which power can be
applied to all axles

SECTION 24- .I Waipio Valley Access Road. between the Waipio Valley
Lookout and the Valley floor shall be closed to all Large capacity passenger vehicles and
those vehicles which are not equipped with all wheel drive,
SECTION 24- .3 Posting of Signs. The Department of Public Works is
her eby directed to post signs on the Waipi'o Valley Access Road to advise the public of the
prohibition in the Article. The language on such signs shall be determined by the
Chief Engineer.
SECTION 24- .4 yxcentions. This Article shall not apply to authorized
emergency vehicles.
SECTION 24- .S. Penalties. Anv person violating provision of this article or any
person owning or having control of a vehicle who knowingly directs the operator of a vehicle to
violate any provision of this Article shall be fined not more than $100.00: or for a second offense
committed within one year after the date of the first offense. be fined not more than $250.00: and
for a third or subseauent offense committed within one year after the date of the offense. be fined
not more than $1.000.00.
SECTION 3. New material is underscored in printing this ordinance, the
underscoring need not be included.
SECTION 4, This Ordinance shall take effect upon approval.
