Subject: H. Co. Energy Conservation Code - Bill 234
I have been working with Emily's office regarding the proposed County Energy Conservation Code
(Ord. 09 -48). I have just finished my review of Shaun Roth's proposed amendments and the
corresponding email communications of today. I fully support Shaun Roth's proposed amendments but
they only correct a portion of the problems, probably a majority of the problems. But what these
amendments create is a need to go through the code and eliminate or modify other sections that are
superseded or cause ambiguities and clean up some of the poorly written sections. Also, in the resent
email correspondence, it is apparent that there still is some confusion and uncertainties. I personally feel
that there is not enough time to do a proper job of amending Ord. 09 -48 in time for next Council
meeting. What ever is hastily done will need to be cleaned up in the immediate future in order to
produce a viable Energy Code.
The only solution that would result in obtaining a well written, viable Energy Conservation Code is to
take the proper time and utilize the available expertise to complete a thorough review and rewrite of the
amendments. The only way to accomplish this is to delay the effective date of Ord. 09 -48 as is the
intent of Bill 234. Even though Bill 234 creates a new effective date in January 2011, which does not
mean that the date can't be earlier. All that is necessary is upon the completion of a thorough review
and the writing of a new adopting Ordinance, the effective date becomes the date the new Ordinance is
passed and signed. A corresponding Ordinance is then passed that repeals Bill 234, thus making the
effective date as soon as the proper review and modifications can be done and its corresponding
Ordinance passed. This allows you the time to properly make the modifications in a reasonable time and
have it become effective at that time.
So, please support and pass the present Bill 234 and avoid any more errors, omissions, oversights and
ambiguities to the proposed Energy Conservation Code. Keep in mind, if a job is worth doing, its worth
doing right; even if it takes a little longer to accomplish.
