Dear Council Members;
My name is Shaun Roth, I am a registered Architect in the State of Hawaii, a member of the
American Institute of Architects, and a member of the International Code Council. This testimony is
my own personal opinion and does not necessarily reflect the position of either of these groups.
I continue to be in support of Bill 234 delaying the effective date of Ordinance 09 48 - IECC 2006.
Amendments to this ordinance are quickly being completed but it seems to be almost certain that it
will not be procedurally possible to have amendments complete and in effect before May 11. Thus
it is very important that Bill 234 is passed and signed by the Mayor before May 11. If the
unamended Ordinance 09 48 is allowed to go into effect on May 11 and then Bill 250 amendments
take effect some weeks or months later there will be a window of time in which all permit
applications for unconditioned buildings will be required to follow the IECC thermal envelope
provisions. This would be very confusing and potentially very costly.
I am in support of Bill 250 (Communication 809) amendments to Ordinance 09 48 with one
exception. In Section 9 the effective date should be a minimum of 90 days after approval to give
design professionals, owners, and contractors time to make adjustments to projects that are
currently being designed. A 90 day delay will also give the Department of Public Works time to
inform their staff of the final language in the ordinance.
Please pass 234.
Please pass 250 with a 90 day effective date.
