We were both born on the Big Island and have been returning to Waimea for the past twenty -five years. We have close relatives in Kawaihae and recognize the economic contributions of Hawaii Petroleum there. We are also very aware of Waimea's attractions to your company but each proposal for further development must be carefully weighed against the impact on the community. As tax - payers to the County of Hawaii we join the chorus of voices that are concerned about the gas station and mini -stop store your company is planning to build at Church Row. The effect this will have on the beauty of the area and the alarming prospect of liquor being sold next door to the churches along the drive are as serious a concern as is the issue of traffic safety along that congested curve of Mamalahoa Highway. We strongly urge Hawaii Petroleum to seek an alternative site for the gas station and reconsider its plans for Church Row. Thank you. As expected, these people don't care at all about Waimea. Voicing our opposition to them is ineffective. I'm also afraid that it is going to take a lot more than just writing a few letters to disinterested politicians to stop them. I've written nearly everyone on your list, and have received no response. (P11 send you copies of the letters.) I really want to see these folks stopped. My perception is that people are looking to you to organize the effort to stop them. Do you see yourself as filling this role? Can we have a special meeting of the WCA to plan a strategy against them? I'm afraid that I have no experience in this area. Box 330754 Kahului, Maui 96733 Dear Mr. Haynes, I'm writing to protest any plan to build a gas - station /convenience store on the commercially zoned property next to Church Row and Keck Observatory offices in Waimea, on the Big Island. It would be an abomination that we would vigorously try to stop. There are four gas stations already in Waimea, three of them with convenience stores. We don't need more! This community is very well organized to prevent this kind of development, that goes against the high standards that have prevailed in Waimea growth thus far. Rest assured that such an enterprise on that site will not be welcome. We will do whatever we can to prevent it. For all the reasons cited in the article by Bill and Patti Cook in the May 11, 200 North Hawaii News, which is an insert for both the island's major newspapers, West Hawaii Today, and the Hawaii Tribune Herald, we are against this development. I have just viewed a rendering of the proposal and now am even more upset. Don't you realize that if you build this station at this location, no one will patronize you and you will lose money? I am very upset at the cost of gasoline here and have started shopping around at for the best bargain. But I can tell you that even if your gasoline was $1 gallon cheaper than anyone else in town, I would not buy gas from you. So who do you think you will sell gas to? Waimea is not a tourist town. You're going to have to depend upon the residents for your livelihood. And - -guess what - -we won't come to you. Wise up. Sell that land to someone who can use it for more appropriate uses. Dear Fellow Waimea Citizens, How about an organized demonstration of some sort? We could picket them in front of their Kawaihae store, and we could also stand in front of the site at Church Row with signs letting all cars passing by know that we do not want a gas station on that site. We could time it so that both happen simultaneously, (and peacefully, of course) with some advance press notice, so that we can get some coverage on the news and/or in the papers. Judging by the turnout at the meeting, if we were organized about this, we could get a lot of people to come out and make a strong visual statement. Waimea Community Assoc. doesn't have to lead it or organize it if that is a problem. I just hoped I could use this email as a means of communicating with everyone who gets the newsletter. Lorenzo Lyons joined dwight Baldwin in 1832. Baldwin only stayed a year but had to leave on account of illlness. His mission covered all of kohala and over to honokohaa. Stone and wood church built in 1832 which collapsed in 1855. Construction was started immediatelyon the present building and completed in 1855. This is the second oldest church on the big island after Kona. Lorenzo Lyons stayed here until his death in 1886 and is buried in the churchyard I believe that Dean Kauka has been advised. Recent history of that park had the whole town rallying to protect it from being turned into a soccer field by the County. The Lions Club, Waimea Outdoor Circle, and representatives from the churches, to name a few, gave testimony at a public hearing to save a precious, beautiful, revered, and even sacred place in our community. I gave testimony at that public hearing. After saving the "Cheny Tree Park" the community joined together to create the Annual Cherry Blossom Heritage Festival so that no one would threaten this special place again. Weddings, christenings, funerals, a church services touch the lives of everyone in the community and are not compatible with gas stations and convenience stores. I hope a business more harmonious with the surroundings can be constructed. Do the demographics really support a 5th gas station in Waimea, or will it be a marginal investment here? We have the well established Kamuela Liquor store and KTA as wellras numerous restaurants. And, in the not too distant future, another large grocery story and Longs, also dispensing liquor. What we do need is to preserve, as much as we can, the flavor and ambiance of what we are: a village - a ranching community - an in- ternationally recognized and respected Scientific community. We are host to this Scientific community and we need to honor our commitment to it. We owe it whatever protection we can give to make it possible for it to continue its work without diminishing the very environment that drew them to us....not only,Mauna Kea's height but ,, the dark skies. While we're working on this problem lets.get at theinconsi'stency of permitting gasoline stations to use whatever' lighting they choose. I would have no difficulty locating a gas station using the lighting that every other is permitted. This is irrational discrimination.... a NO BRAINER!!! A gas station between Keck Observatories and Church Row Park in Waimea on Hawai'i Island is a sacriledge! We already have a Chevron (with Convenience Store) and a Shell station only one block Kona -side (West) and a Texaco (Tesoro) with Convenience Store only one block Hilo -side (East) of Church Row Park. Must we have a gas station in every block! With the remodeling lights being planned for Parker Ranch Center this additional brilliance would definitely endanger the capabilities of the observatories on Mauna Kea. The Waimea Arts Council is very actively involved with the Annual Cherry Blossom Heritage Festival which is held in the vicinity of Church Row Park every February. The year 2001 will be our Eighth year and this type of structure, in this particular location, would have a negative impact on this activity as well as on the soccer field across the street and the five churches in the immediate area. Unfortunately we were unable to attend the meeting held on Thursday, but wanted to express our concern of your proposal to build another convenience store and gas station. We love this town. I'm sure you can understand why having been here. It is a small town and the local business thrive on the population that currently exists. While we recognize that this town is indeed growing, we feel that another gas station so close by would take away from the small town feel, especially since the need is plenty filled with the ones currently in operation /existence. Furthermore, to sell liquor at this particular location would concern us greatly. Why? Well I'm sure you are aware that that area is known as "church row" and has been for many years. To place a business establishment right there, and one that sells liquor would be totally inappropriate. Need we say more ? ?? I'm sure you realize the concerns are obvious. Perhaps you could consider some other type of "income producing" building, such as an office building of sorts. Or something for the children of our community. But not another convenience store. And certainly not one that would sell liquor. PLEASE. We love this town. Please respect the feelings of this community. Perhaps a little old fashioned PICKETING might be raised. Since it certainly is not needed - -at that spot, anyway. Within one block either way, there are stations already. Anyone bothered to check these situations out ? ?? That's a pretty fantastic area - -yet. Vibrations alone is unthinkable. 1 really don't like to label this for what it is, cause, there is so much of it in the world today, anyway. Let's get a little caring and heart feeling into this great idea. Precious Waimea going by the wayside too now, it looks like. Land is so special to us all and it gets more cement nut on it everyday. This is the first time - ever -of viewing my opinions of what those "out there" in charge, say is going to be done. Box 330754, Kahului, Maui, 96733 Dear Mr. Haynes, I am extremely disappointed to learn that you have plans for a gas station /convenience store to be located on the last vacant piece of property on Church Row in Waimea. I urge you to consider the following: The Waimea community, of which I have been a member for 24 of the Last 31 years, has spent many, many hours during those years discussing the special ambience of our town, its future needs and its appeal to residents and tourists alike. The Waimea Design Plan was prepared and adopted by the community to guide future growth. Much of the Plan concerns the appearance of our town. Recently, there was tremendous public input to make sure the refurbishment of our main street was designed to be as attractive, safe and user - friendly as possible. The Lindsey Road /Kawaihae Road intersection realignment is underway which has also generated much community interest as it involved the cutting of mature trees and the realignment of an existing rock wall. There are many residents who are actively involved in maintaining and improving the natural beauty and character of our town through volunteer efforts. The Nature Park just off Ahuli Circle, and Waimea Trails and Greenways, and the annual Cherry Blossom Festival are but three examples. Tremendous community effort and support has gone into planting, maintaining and publicizing the stand of cherry trees along Mamalahoa Highway that greet visitors and provide a lacy foreground for Church Row. We are blessed with a lovely expanse of passive buildings and green hills at the entrance to Waimea town. And now we are faced with another attempt to lessen the beauty of one of the most pleasing aspects of our town. Church Row will be far less appealing with the constant traffic, unsightly advertising, tall signs and bright lights that always accompany the kind of gas station /convenience stores you propose. I hope the Big Island Planning Commission recognizes the community's efforts, involvement and public voice to keep our town attractive and avoid the helter - skelter building that has happened elsewhere on this island. How many gas stations does Waimea need? At current count there are four and waiting lines are non - existent. I implore the Planning Commission to be sensitive to Waimea residents' input into the Waimea Design Plan. 'Paps because you are not a residei•Waimea, you are not &aware of the impact your development would have on our town. Please be sensitive to one of the most lovely parts of Waimea. Yes, commercial property rights do exist. But have we lost all sense of community and what is appropriate? Could the last vacant piece of Church Row property not be dedicated to a more passive use? Could it not be rezoned to prevent a 24 -hour brightly lit eyesore from littering the entrance to Waimea? And what will be the impact of noise, traffic, light and chemical pollution on the hospital across the road or the sleeping observers at Keck observatory next door? We urge you to work with our community to find an alternative to adding a 24 -hour gas station /minimart to Church Row. I am a homeowner and taxpayer in Waimea and am frustrated by traffic problems. I have purchased a bicycle to get around town. We endured many plans and expenses to modify Mamalahoa Highway. There are no bike paths in Waimea, yet we are asked to accommodate an unplanned development on a sensitive corner. It's Hawaii Petroleum's land to do with what they will. But the mentality of selling liquor near a Baptist Church brings home how appallingly out of touch and disrespectful it is to the land, as well as poor traffic planning. Please consider using the parcel where a gas station used to be, near Goodyear. This site offers catching those customers headed in that direction and is a more appropriate location for this type of endeavor. I want to let you know in writing that I agree with the vast majority of residents on the points they made regarding the detrimental impacts your proposed Minit Stop Store on Mamalahoa Highway between Church Row Drive and Keck Observatory headquarters would have on the community, including: A significant increase in traffic on Church Row Drive, which is a seriously substandard County road, in a residental area within yards of five churches; Safety issues over access/egress onto Mamalahoa Highway on a high traffic curve directly across from the new emergency access road to North Hawaii Community Hospital; Aesthetic impacts creating visual blight on one of the most beautiful landscapes on the Big Island - an area with dozens of flowering cherry trees and architecturally significant churches - an area dedicated to the community's Japanese heritage and traditions; Bright lights until at least 11:00 pm - and perhaps all night long in the future - in an area that is still relatively free of light pollution. Keck Observatory's manager Ron Laub believes this is a major problem for their astronomers, as it is for the many immediate residences; Noise impacts on both passive Cherry Blossom Park and the daytime sleeping quarters at Keck headquarters for visiting astronomers; Liquor sales within yards of five churches(!); Prospects of people parking and drinking in Church Row Park and on adjacent church property and residences; _ Ad infinitum. Suffice it so say that the sentiment in this community is strongly against such a use, and you would be going against the wishes of the community if you approve this application. Please represent and support the community on this issue. Between 1992 and 1997 I served as the Executive Team Leader (CEO) of North Hawaii Community Hospital. During this time it was my job to steer every aspect of the planning, construction and opening of this new hospital. I learned how critically important it was to work with the community and the govemmental agencies every step of the way to make sure that our plans and actions reflected their interests and concerns. Even though the entire North Hawaii Community was behind the need for a new, full service hospital, we were intensely watched and scrutinized to make sure that the grounds and facility were designed in every detail to fit the character and nature of our location and community. The result was a very successful project and a facility that clearly adds to this area of Waimea which includes the Keck Observatory offices, Lucy Henriques Medical Center and Church Row. We would never have thought of doing anything to this highly valued part of our community that would detract from its character. The community here loves the green lawns, the trees and the pleasant appearing structures, both historical and new, that make up this part of Waimea. To approve a common gas station right in the middle of this area which we have all labored over for many years to carefully develop and maintain would be an insult to all our past efforts and to the leaders of our community. I simply can not understand how such a proposal could be given any serious consideration. Approving this proposal literally would be a shock that would be felt for years to come throughout this community. The respect for and confidence in the Planning arm of the County would be seriously affected, perhaps permanently. Why? Because you would not have respected nor had confidence in us. The use of the Church Row land for this purpose is inappropriate, and conflicts with the neighborhood as a whole. It will be ugly and intrusive in this setting. The proposed use also negatively impacts the amenities in adjacent areas, and is not compatible with adjacent land uses. Traffic will increase in this area unnecessarily, and will cause safety problems. If a car wash is included in this plan, it could unfairly draw from our already limited water supplies as well as impact our wastewater disposal, streams, and/or groundwater resources. The use of this land for this purpose conflicts with the land use concept map in the Waimea Design Plan. Imagine if you will...a service in progress at any one or all of the churches and a loud engine truck, vehicle or motorcycle riders pull in revving engines. Our beautiful Church row is a unique part of what makes Waimea so special: We can go anywhere in the country and see a gas station /minimart. If we must have another one, lets put it in a less picturesque part of town where it wont impede the access to the Emergency Room ambulance roadway. This curve is already congested with restricted views when the ambulances are entering from the Hamakua direction. The traffic heading towards Hamakua is usually moving extra fast after racing to merge in front of the hospital. A gas staion will inevitably add cars wanting to cross hwy 19 heading towards Hamakua. This additional traffic into and out of the station would only add to the problem of getting from the highway to the ER quickly. As you know, time is critcal in emrgency medicine .Driving an ambulance through the front entrance of the hospital and around to the back takes one to two minutes longer and can be uncomfortable for the patient because of all the curves and bends in the road. I began my residency on the Big Island in 1966 as a member of the Peace Corps training program staff, then located in Hilo. I have been a Hawaii resident since then, having lived and worked in Waimea since November 1989. I truly love this island and especially love Waimea. I own two properties in Waimea, my home and my office, wherein I maintain a private practice as a clinical psychologist. I have been a member of Waimea MainStreet since it's inception and have been a member of its board of directors for the past several years. I am also a member of the Waimea Community Association. This brief history is included only to let you know I have a true interest in and commitment to this community. I am not opposed to development of my community; indeed, I have been a part of its development. However, I am most interested in the kind of development that preserves and promotes what many of us believe is reflective of the best of our heritage and culture. And for that reason I am extremely concerned and strongly opposed to the subject proposal. I want to support you and urge you to apply the guiding statutes with the greatest of care in your consideration of the development request. From my reading and understanding of the principles and factors involved in this growing dispute, it does seem rather obvious that the proposal is clearly not in conformance with many of the standards. I have most recently reviewed a copy of councilman Elarionoff s proposed resolution regarding this matter and which is to be submitted to the Council November 2; 1 believe it to be a comprehensive review of the situation and urge your careful attention to it as well. We have the well established Kamuela Liquor store and KTA as well as numerous restaurants. And, in the not too distant future, another large grocery story and Longs, also dispensing liquor. What we do need is to preserve, as much as we can, the flavor and ambiance of what we are: a village - a ranching community - an in- ternationally recognized and respected Scientific community. We are host to this Scientific community and we need to honor our commitment to it. We owe it whatever protection we can give to make it possible for it to continue its work without diminishing the very environment that drew them to us....not only Mauna Kea's height but the dark skies. While we're working on this problem lets get at the inconsistency of permitting gasoline stations to use whatever lighting they choose. I would have no difficulty locating a gas station using the lighting that every other is permitted. This is irrational discrimination.... a NO BRAINER!!! Your lot is located next to a special even spiritual place, Church Row Park, with its several churches , the most special being the historic Imola Church begun by the legendary Father Lyons. A gas station /convenience store selling alcohol open possibly 24 hours a day would be almost sacrilegious. We are sure you will hear from the Keck Observatory on the other side of your property objecting to the late hours and undoubtedly loud noise while their visiting astronomers try to sleep in preparation for their time on the Mauna Kea telescopes. Your plan will certainly be strongly objected to by these fine neighbors. Safety must be taken into account. There is no egress or entry from that site except through the Church Row which is a one lane road and no one wishes to see it "improved ". It is fine and suits this community the way it is. I am writing in my capacity as President of the Waimea Community Association (WCA) and my comments are based on personal opinion and statements expressed by community , members. I understand WCA Planning and Design Review Committee is also forwarding comments to you concerning this proposal. At a recent WCA Town Meeting featuring the proposed use, the community voiced the opinion that just because the property owner may have the "right" to build a gas station /convenience store, it does not mean it is the right thing to do. Apparently the landowner isn't listening to the near unanimous position taken at that community meeting, attended by more than 150 people with over 40 people expressing their objections to the project. All speakers provided firm, but polite statements of opposition to the gas station /convenience store proposal - -- its use and probable design. When the audience was asked its position on the project, virtually everyone stood in opposition. Only representatives of prior and present landowners remained seated. The community did not say the owner cannot do anything with his land. On the contrary, many expressed support for his right to build an office or medical building or similar use and indicated they would assist him if he pursued these more passive uses of the site. Zoning Ordinance Requires Plan Approval The Hawaii County Zoning Ordinance states that Plan Approval is required for the proposed use and the Plan Approval process is established to allow closer inspection of developments to ensure their conformance with the General Plan and to ensure pertinent conditions have been implemented. The Zoning Ordinance further states that the Planning Director may issue Plan Approval subject to conditions or changes to proposals which are necessary to carry out and further the purposes of zoning. It further states: the director shall consider the proposed structure, Recommendation to D oposed Church Row Gas Station venience Store /Car Wash Page 2 August 16, 2000 development or use in relation to the surrounding property, improvements, streets, traffic, community characteristics and natural features. I understand the landowner has or will shortly submit applications for Plan Approval and other use and building permits. This letter is submitted in anticipation of these applications. My comments are based on preliminary drawings submitted by the landowner, conversations with the owner and Town Meeting comments. Private Property Rights -- Not Exclusive, Nor Unconditional Some have suggested that since the property is zoned Village Commercial, the property owner has private property rights that inherently and unilaterally permit him to construct dnd use his proposed buildings as a gas station /convenience store /car wash. Private property rights permit an owner to build and use legally permissible improvements on his property. BUT ... private property rights are not exclusive, nor are they unconditional. The same document (Zoning Ordinance) that grants the conditional right to build and use an automobile service station on the site also requires that the Planning Director assure that the use and structure conform to the General Plan and further limits how and where the improvements are constructed. Because the proposed use and building design do not conform with various Plans and the surrounding neighborhood, and actually conflict with the nature of the neighborhood, I believe the Plan Approval application and related use and /or building permits should be denied. Proposed Use and Buildings Conflict with Hawaii County General Plan The General Plan describes itself as the policy document for the long -range comprehensive development of the island of Hawaii. It provides the direction for the future growth of the County and brings into focus the relationship between residents and their pursuits and institutions. The General Plan provides the legal basis for intermediate regional and functional plans, as well as provides the basis for Zoning. One of the two stated Goals in the General Plan relative to commercial development states the General Plan is to "provide commercial developments that complement the overall pattern of transportation and and usage within the island's regions, communities and neighborhoods." The proposed use clearly does not 'complement' the neighborhood. In fact, it conflicts with the land usage in the neighborhood and, if permitted, will change -- not complement -- the nature of the neighborhood. The subject property sits in the middle of an area that is a significant link between Waimea's past and future. The property is situated among a significant collection of Waimea's churches (including Imiola Church which is on the Hawaii Register and National Registry of Historic Places) and its Recommendation to Dlroposed Church Row Gas StationSvenience Store /Car Wash Page 3 August 2000 neighbors include the campus -like North Hawaii Community Hospital (Hospital), Waimea Civic Center and WM Keck Observatory base facilities (Keck). The neighborhood also has a passive park (Church Row Park) situated across Church Row road from the subject property. Community opposition to active use in this area is not new. When Church Row Park was proposed to be redeveloped to include a soccer field, the community rose in opposition, noting its desire to retain the tranquil and peaceful nature of the area (even though opposition meant delay in construction of much - needed active playing fields for our children and families.) The proposed use will forever change the look and nature of the neighborhood; this conflicts with the goal of the General Plan and, therefore, the Plan Approval application and other use and /or building permits should be denied. Traffic Concerns -- Recommendation for Study While we do not know the anticipated amount of automobile traffic that might ultimately use the proposed gas station /convenience store /car wash, the developer indicates that approximately 100 cars per day are projected to use just the car wash component of the site - -- we can expect the gas station /convenience store components will significantly surpass this activity. This is a significant increase in daily use of the neighborhood roads. The proposal could cause significant negative impacts in the area, particularly when compared with, the passive, peaceful nature of the existing neighborhood. The proposed use may require that extensive improvements be made to the intersection and roadway adjoining the property. In order to effectively identify the anticipated automobile traffic impact that this proposal may cause, the developer should be required to prepare an extensive traffic study. This study should identify anticipated traffic counts and identify the impact on the surrounding uses, as well as address options to mitigate any negative traffic impact. If negative impacts are identified, Church Row road and the surrounding neighbors should not be forced to conform to 'urban' design standards that increased traffic may require. On the contrary, Waimea Design Plan specifically states that "the construction of roads to rural standards - without curbs, gutters and sidewalks, is a major aspect of the ranch character of Waimea." Church Row road is fine the way it is; rather than "urbanize" the area, the proposed Plan Approval application and related use and /or building permits should be denied. Water 8 Wastewater Concerns -- Compliance Study Required Though initially discussed as a gas station /convenience store, the proposal now, unfortunately, includes a car wash - -- if permitted, Waimea's first. While I do not know the water usage to mechanically wash 100 cars per day, nor do I know of the appropriate wastewater disposal, I do know that Waimea's water source and storage Recommendation to De oposed Church Row Gas Station venience Store /Car Wash Page 4 August 1.6, 200p are finite and we have no public wastewater facility, only private water wells and private wastewater plant. • We are one of the few Big Island communities whose public water system relies solely on surface water collection and storage. When it doesn't rain, water doesn't fill our reservoirs - -- if this continues we run out of water. The reality of this precarious water system is best seen during the times of drought - -- as we have recently experienced. During droughts, various water restrictions are imposed on the community; usually the first level of restriction limit lawn watering and car washing. Wastewater disposal may not simply involve the traditional digging of an underground injection well. Local drainage concerns and neighboring flood control improvements suggest the underlying soils may not readily percolate injected wastewater. In order to effectively identify the anticipated water consumption and wastewater disposal associated with the proposed use and how the use may impact the community and our limited water resources and wastewater disposal alternatives, the developer should be required to prepare an extensive water consumption and wastewater disposal study. If it is concluded that the proposed use unfairly draws from the community's limited water resources or the disposal of wastewater negatively impacts our community, then the proposed Plan Approval application and related use and /or building permits should be denied. Proposed Use Conflicts with Waimea Design Plan Objectives There are serious concerns not only about the property's use but also design for this sensitive area of Waimea. We respect the historic, scenic and cultural nature of our town and have attempted to identify and define these unique characteristics and values in our Waimea Design Plan. It is this document that governs our long standing advisory relationship with Hawaii County Planning Department. Adopted by Council resolution, Waimea Design Plan is the "official document to guide future development and construction design in Waimea." There is very little landscaping and the proposed use covers essentially all of the 23,000 SF lot with buildings or pavement. • The visual damage to the historic area and scenic vistas is significant because the proposed architecture cannot be anything but a decorated gas station with a tall canopy that is over - lighted to draw attention to itself. Imagine standing at (or driving near) the Hospital entrance, looking across the front lawn of Keck toward Imiola Church - -- your view will be blocked by a well -lit, free- standing gas pump canopy with a clear view into a convenience store. A design objective in Waimea Design Plan encourages functional design which is compatible with local weather. Last year, after I first learned that a prospective buyer was considering a gas station, fast food operation or office building, I called the prospective buyer and asked him to a meeting with other Waimea community representatives. In that meeting almost a dozen community leaders conveyed a very strong and steadfast message that a gas station or fast food outlet were not considered appropriate uses of the site. They presently operate the Shell station and convenience store at Kinohou (the former Texaco station on the Honoka'a side of town) and recently built and operate the Minit Stop gas station and convenience store in Kawaihae. To his credit, the property owner has had several meetings with WCA Planning and Design Review Committee and the proposal was the focus of a regularly scheduled WCA Town Meeting. I have had many conversations and considerable correspondence with the landowner. Though we disagree on the project and it's impact, we can and do communicate. I appreciate his willingness to talk about the issue. Waimea: Rural Paniolo Town or Cross - Island Fueling Depot? Some have suggested that Waimea does not need another gas station/ convenience store-- - we already have four. The relative number of competing businesses, however, should not be a measure of whether another one should be allowed. Our regulated free - market system encourages legitimate businesses to compete - -- and succeed or fail on their own merits. Unfortunately, if economics prove we actually do have too many gas stations, the community may suffer with an abandoned, special purpose building. It is interesting (and unfortunate) to note that the rural, paniolo town of Waimea could soon be viewed as the cross - island automobile fueling depot. Waimea at the Crossroads For years Waimea has endured the negative impacts of transient cross - island vehicular traffic. Geography put Waimea at the burdensome crossroad link between East and West Hawaii. Waimea is now at another crossroad - -- this one deals with how we look to our future. Do we stand back and hope the right things will happen - -- or, do we take some control of how, why and where we grow? I propose we do the latter and voice our serious concerns about the proposed gas station/ convenience store /car wash planned at Church Row and take some control of our future. The proposed gas station /convenience store /car wash use and design will forever change the look and nature of the neighborhood - -- if it is built, Church Row will never be the same. I do not want future generations wondering why we let this proposal move forward. This view point addresses prospective Plan Approval and other permits required for the project to continue. I am writing in my capacity as President of the Waimea Community Association (WCA) and my comments are based on personal opinion and statements expressed by community members. At a recent WCA Town Meeting featuring the proposed use, the community voiced the opinion that just because the property owner may have the "right" to build a gas station /convenience store, it does not mean it is the right thing to do. Apparently the landowner isn't listening to the near unanimous position taken at that community meeting, attended by more than 150 people with over 40 people expressing their objections to the project. All speakers provided firm, but polite statements of opposition to the gas station /convenience store proposal - -- its use and probable design. When the audience was asked its position on the project, virtually everyone stood in opposition. Only representatives of prior and present landowners remained seated. The community did not say the owner cannot do anything with his land. On the contrary, many expressed support for his right to build an office or medical building or similar use and indicated they would assist him if he pursued these more passive uses of the site. Gas Station at Church Row, Wai Page 2 August 16, 2000 Zoning Ordinance Requires Plan Approval The Hawaii County Zoning Ordinance states that Plan Approval is required for the proposed use and the Plan Approval process is established to allow closer inspection of developments to ensure their conformance with the General Plan and to ensure pertinent conditions have been implemented. The Zoning Ordinance further states that the Planning Director may issue Plan Approval subject to conditions or changes to proposals which are necessary to carry out and further the purposes of zoning. It further states: the director shall consider the proposed structure, development or use in relation to the surrounding property, improvements, streets, traffic, community characteristics and natural features. I understand the landowner has or will shortly submit applications for Plan Approval and other use and building permits. This letter is submitted in anticipation of these applications. My comments are based on preliminary drawings submitted by the landowner, conversations with the owner and Town Meeting comments. Private Property Rights -- Not Exclusive, Nor Unconditional Some have suggested that since the property is zoned Village Commercial, the property owner has private property rights that inherently and unilaterally permit him to construct and use his proposed buildings as a gas station /convenience store /car wash. Private property rights permit an owner to build and use legally permissible improvements on his property. BUT ... private property rights are not exclusive, nor are they unconditional. The same document (Zoning Ordinance) that grants the conditional right to build and use an automobile service station on the site also requires that the Planning Director assure that the use and structure conform to the General Plan and further limits how and where the improvements are constructed. Because the proposed use and building design do not conform with various Plans and the surrounding neighborhood, and actually conflict with the nature of the neighborhood, I believe the Plan Approval application and related use and /or building permits should be denied. Proposed Use and Buildings Conflict with Hawaii County General Plan The General Plan describes itself as the policy document for the long -range comprehensive development of the island of Hawaii. It provides the direction for the future growth of the County and brings into focus the relationship between residents and their pursuits and institutions. The General Plan provides the legal basis for intermediate regional and functional plans, as well as provides the basis for Zoning. One of the two stated Goals in the General Plan relative to commercial development states the , General Plan is to "provide commercial developments that complement the overall pattern of transportation and land usage within the island's regions, communities and neighborhoods." The proposed use clearly does not 'complement' the neighborhood. In fact, it conflicts with the land usage in the neighborhood and, if permitted, will change -- not complement -- the nature of the neighborhood. The property is situated among a significant collection of Waimea's churches (including lmiola Church which is on the Hawaii Register and National Registry of Historic Places) and its neighbors include the campus -like North Hawaii Community Hospital (Hospital), Waimea Civic Center and WM Keck Observatory base facilities (Keck). The neighborhood also has a passive park (Church Row Park) situated across Church Row road from the subject property. Community opposition to active use in this area is not new. When Church Row Park was proposed to be redeveloped to include a soccer field, the community rose in opposition, noting its desire to retain the tranquil and peaceful nature of the area (even though opposition meant delay in construction of much - needed active playing fields for our children and families.) The proposed use will forever change the look and nature of the neighborhood; this conflicts with the goal of the General Plan and, therefore, the Plan Approval application and other use and /or building permits should be denied. Traffic Concerns -- Recommendation for Study While we do not know the anticipated amount of automobile traffic that might ultimately use the proposed gas station /convenience store /car wash, the developer indicates that approximately 100 cars per day are projected to use just the car wash component of the site - - -we can expect the gas station /convenience store components will significantly surpass this activity. This is a significant increase in daily use of the neighborhood roads. The proposal could cause significant negative impacts in the area, particularly when compared with the passive, peaceful nature of the existing neighborhood. The proposed use may require that extensive improvements be made to the intersection and roadway adjoining the property. In order to effectively identify the anticipated automobile traffic impact that this proposal may cause, the developer should be required to prepare an extensive traffic study. This study should identify anticipated traffic counts and identify the impact on the surrounding uses, as well as address options to mitigate any negative traffic impact. If negative impacts are identified, Church Row road and the surrounding neighbors should not be forced to conform to 'urban' design standards that increased traffic may require. On the contrary, Waimea Design Plan specifically states that "the construction of roads to rural standards - without curbs, gutters and sidewalks, is a major aspect of the ranch character of Waimea." Church Row road is fine the way it is; rather than "urbanize" the area, the proposed Plan Approval application and related use and /or building permits should be denied. Water & Wastewater Concerns -- Compliance Study Required Though initially discussed as a gas station /convenience store, the proposal now, unfortunately, . includes a car wash - -- if permitted, Waimea's first. While I do not know the water usage to mechanically wash 100 cars per day, nor do I know of the appropriate wastewater disposal, I do know that Waimea's water source and storage are finite and we have no public wastewater facility, only private water wells and private wastewater plant. When it doesn't rain, water doesn't fill our reservoirs - -- if this continues we run out of water. The reality of this precarious water system is best seen during the times of drought - -- as we have recently experienced. During droughts, various water restrictions are imposed on the community; usually the first level of restriction limit lawn watering and car washing. Wastewater disposal may not simply involve the traditional digging of an underground injection well. Local drainage concerns and neighboring flood control improvements suggest the underlying soils may not readily percolate injected wastewater. In order to effectively identify the anticipated water consumption and wastewater disposal associated with the proposed use and how the use may impact the community and our limited water resources and wastewater disposal alternatives, the developer should be required to prepare an extensive water consumption and wastewater disposal study. If it is concluded that the proposed use unfairly draws from the community's limited water resources or the disposal of wastewater negatively impacts our community, fhen the proposed Plan Approval application and related use and /or building permits should be denied. Proposed Use Conflicts with Waimea Design Plan Objectives There are serious concerns not only about the property's use but also design for this sensitive area of Waimea. We respect the historic, scenic and cultural nature of our town and have attempted to identify and define these unique characteristics and values in our Waimea Design Plan. Box 330754 Kahului, Maui, 96733 Dear Mr. Haynes and Mr. Dixon: This letter is to express my great concern about the proposed development of a 24 -hour gas station and convenience store on the lot owned by Nanea, Inc. on Mamalahoa Highway in Waimea. While I do not oppose commercial use of the site, I am hoping that you will reconsider your plans to a more appropriate commercial use. Some of my concerns are: Visual Impact I feel that the proximity of such an establishment to the Cherry Tree Park would seriously compromise the beauty of this very special part of town The W.M. Keck Observatory is a cutting edge, world -class facility which receives a lot of publicity worldwide. I think an establishment such as the one proposed would compromise the image of Waimea and the Observatory as seen via the media. Traffic I have heard that ingress would be restricted to an existing easement from Church Row Drive. I feel that this is highly inappropriate. Also, 1 do not think it is appropriate to have this sort of establishment so near the entrance /exit to an hospital emergency room. Alcohol I do not think it is appropriate to sell alcohol so close to churches. • • Noise I feel that noise would seriously compromise the activities at the Churches, Park, and Observatory, which are typically peaceful and quiet. • • • Lights I am concerned whether or not the plans comply with Light ordinances. The astronomy industry has a very Large positive impact on the local economy and I feel that we need to protect this industry. Mauna Kea is currently the premier observing location in the Northern hemisphere, and it needs to be protected. You must have given some consideration to the fact that Church Row and Cherry Blossom Park are special and sacred places in this wonderful town. Do you, coming from a Kama'aina family, truly believe that a gas station and convenience store where liquor is sold, is compatible with historic Church Row and the lovely Cherry Blossom Park? Do you truly believe the community can support a business such as this? Do you believe that the peace of this place is going to be preserved by a gas station and 24 hour convenience store? We are very familiar with this most unattractive place in Kawaihae and have observed the traffic congestion and activities there. It is shocking to think that something like it will be put in the neighborhood not only of our churches but also of the beautiful Keck facility and the North Hawaii Community Hospital of which we are so proud. I fully understand that you have every right to build such a place on the property you purchased for a large amount of money. However, I would like to urge you not to do so for the good of our community. My wife and I just spent a wonderful two weeks in Waimea and the surrounds, outfitting our new (to us anyway) 2nd home just east of town (in Pu'u kapu Pastures). While in town we became aware of the convenience store debaucle, and I wanted to extend our thanks for your continuing fight against the, um, well the word that comes immediately to mind is "monstrosity ". We discovered Waimea during a three -hour visit last year there, having spent the rest of our 3 days on the Big Island in Kona and down south at the caldera. Boy did we have our priorities wrong! Unfortunately we had to catch a plane back to the mainland that same day, but we've been back twice since, and recently made the initial steps that will enable to hopefully live there full -time someday. To us Waimea is heaven on earth! I cannot understand how anyone who has been there could even think of destroying the ambience of that (or any) part of town with such a scheme. At the very least the so- called "developer" (poor use of the word) could propose a structure that follows the spririt of Waimea - just like the new restaurant that revitalized an old building into something that looks very nice! (The restaurant name escapes me right now but you probably know the one I mean - the yellow one 8*) .) That should be a minimum requirement for the "developer" to get permission to break ground at the very least, One thing I am curious about - does Waimea or the district or whatever have any ordinances against lighting systems that will compromise the ' night sky? Our place is about three miles from the proposed building site, so it's conceivable that the "developer "'s irresponsible use of lights could create a skyglow. Hey, that's one of the reasons I want to leave this (San Jose) area someday_.. If there is not such a thing in place, please let me know who I can call to plead with to have an ordinance instilled. We're back in Realityville (San Jose) and won't be able to come back until'probably March so it'd be tough for us to sign a petition or anything, but please keep us updated (via the newsletter) on the progress of the fight. I am cc'g the Planning Department on this, and my message /plea to them is: "Please please do not let this guy come in and make yet more progress in erasing what makes Waimea the most special place my wife and I have ever been to (we're both 41 and have been around the world a bit)." I initially wrote to you regarding this subject on August 16, 2000. At that time we anticipated the submittal of an application for Plan Approval. We understand that an application for Plan Approval has recently been submitted by the property owner. We feel that the application is incomplete at this point and additional studies and information must be provided before formal review of the application can be made. We believe you should not accept the application at this time until it is complete. We ask that you take into account the following in your consideration of completeness of the application. In addition, the following should be considered in the subsequent review of the application prior to issuing Plan Approval. Traffic -- Recommendation for Study We believe that the proposed use will significantly (and negatively) impact the roads in the area with increased traffic. In order to effectively analyze the situation we believe a current traffic study should be completed that incorporates the property owner's proposed use, anticipated traffic counts and the impact they have on the neighboring roads and surrounding uses. We understand the owners estimate they will have 100 cars per day for just the car wash component of their use. Recent discussions with the existing Shell station at Mamalahoa and Lindsey indicate they experience approximately 500 cars per day. This volume of traffic significantly increases the use of Church Road; the traffic study will evaluate the impact on the road and the surrounding properties and proposed mitigation. If negative impacts are identified, Church Row road and the surrounding neighbors should not be forced to conform to 'urban' design standards that increased traffic may require. On the contrary, Waimea Design Plan specifically states that "the construction of roads to rural standards - without curbs, gutters and sidewalks, is a major aspect of the ranch character of Waimea." We ask that the WCA Planning and Design Review Committee and the South Kohala Traffic Safety Committee have the opportunity to review and respond to the traffic study Page 2 •oposed Gas Station Church Row • October 16, 2000 and proposed mitigation. We, therefore, ask that you extend the Plan Approval review period to allow for the traffic study preparation and review. Water & Wastewater -- Compliance Studies Required In order to effectively identify the anticipated water consumption and wastewater disposal associated with the proposed use and how the use may impact the community and our limited water resources and wastewater disposal alternatives, the developer should be required to prepare an extensive water consumption and wastewater disposal study. We need to assure that the proposed use does not negatively impact our existing water resources, ground water resources, run -off to Waikoloa Stream and related matters. We ask that the WCA Planning and Design Review Committee have an opportunity to review and respond to the water and wastewater studies. We, therefore, ask that you extend the Plan Approval review period to allow for the water study and wastewater study preparation and review. Environmental Assessment Needs to Be Prepared We understand the subject site was long ago used as an 'ice house'. We know that environmental concerns then were not as critical as they are today. There may be residual hazardous wastes and materials on the site that can only be found if an environmental review is made. We ask that appropriate environmental studies be made to assure that the site is free of hazardous materials or appropriate mitigation occurs. We ask that the WCA Planning and Design Review Committee have an opportunity to review and respond to the environmental study. We, therefore, ask that you extend the Plan Approval review period to allow for the environmental study preparation and review. Proposed Use Conflicts with Waimea Design Plan Objectives We respect the historic, scenic and cultural nature of our town and have attempted to identify and define these unique characteristics and values in our Waimea Design Plan. It is this document that governs our long standing advisory relationship with Hawai'i County Planning Department. Adopted by Council resolution, Waimea Design Plan is the "official document to guide future development and construction design in Waimea." Initiated by Waimea Community Association (then known as Waimea - Kawaihae Community Association), the Plan seeks to preserve the "paniolo" character of the community and develop and implement architectural guidelines consistent with the "paniolo" character. Design objectives in the Waimea Design Plan include (among others): - encourage that new commercial structures complement the environment; - preserve historic buildings and sites; - enhance the character of Waimea and to encourage landscaping and landscape elements such as signage, paving and lighting; - encourage a respect for local weather conditions in the design and orientation of buildings; and - ensure compatibility with adjacent land uses Page 3 •posed Gas Station Church Row • October 16, 2000 The visual damage to the historic area and scenic vistas is significant because the proposed architecture cannot be anything but a decorated gas station with a tall canopy that is over - lighted to draw attention to itself. A design objective in Waimea Design Plan encourages functional design which is compatible with local weather. A typical gas station pump - island canopy is ineffective shelter in Waimea; prevailing winds deposit rain at an angle -- almost horizontally, not vertically. The canopy will serve no function - -- except as an illuminated beacon to passers -by. The proposed use and building design do not complement the environment. The proposed use conflicts with the quiet, peaceful nature of the neighborhood. The proposed buildings do not enhance the character of Waimea. Landscaping is virtually non - existent. The use and buildings are not compatible with the adjacent land uses. For these reasons, the Plan Approval application and related use and /or building permits should be denied. Proposal Does Not Provide Adequate Information for Review Issues such as alternative site layout, building orientation, materials, roof line, colors and tones (should be light absorbing -- complementary to the natural environment), door & window types (should be paneled), signage (should be ground signs compatible with the area in general), landscaping detail, fencing and exterior lighting are not addressed because design details were not disclosed. Until the detail and specifications are submitted, the Plan Approval application is incomplete and review and comment is premature. The Plan Approval review period should not start until the application is complete with adequate information about materials, colors, signage, lighting and other specifications. Recommendation For Studies and Opportunity to Review and Comment We feel that appropriate studies need to be prepared and additional detail and specifications provided to assure that the proposed use conforms with all laws, codes and ordinances, and that the environment and surrounding properties are not negatively impacted by the proposed use. As a minimum, the following studies and details should be presented and reviewed: Traffic Water Consumption Wastewater Disposal Environmental Assessment Building Design and Specifications, Signage, Lighting and Landscaping Detail Only after these have been prepared can an effective review of the proposal be made. The application should not be considered complete until this information is provided. We, therefore, ask that these and any other appropriate studies be prepared and the WCA Planning and Design Review Committee have an opportunity to review them. The Plan Approval review period should be extended for the preparation and review of these studies and specifics. Dear Ms. Goldstein: I am writing you to state in strongest possible terms my opposition to the referenced application. I have lived in Hawaii since 1973 and in Waimea since 1989. I have long been a member of the Waimea Community Association, of Waimea Main Street, and of' several other "core" Waimea community organizations. And I am a businessman, clearly NOT hostile to appropriate, well- thought out new ventures and "progress." In fact, I am co- founder and Vice- President of one: Waimea - basedPhase Inc., an environmental equipment design firm. For you to carefully consider of course are the facts (so eloquently stated in the Hawaii County Council Resolution to be introduced by Councilman Elanionoff this week), that this proposed project — right next to historic Church Row — clearly violates so much of the intent, and many of the provisions of community and county planning. This project's gross inappropriateness appears to have created an unusual condition in our community — virtually ALL of Waimea's various interests and factions are united in their opposition to this ill- advised scheme! An interesting accomplishment. MY MAIN POINT: However, I wish to add one additional avenue of thought to what I expect has been considerable "feedback" to your office regarding this project. It's this: Waimea and environs do NOT have the population to support FIVE gas stations / mini -marts within a two -mile radius. Read on: Already within the town center area, we have (1) Opelo Comer (corner of Opelo Road and Highway 19), which is a gas station and mini -mart. We also have (2) the Chevron Station at the corner of Mamalahoa Highway and Highway 19, which is ALSO a gas station and mini -mart. We also have (3) the long - standing, local family -owned Shell gas station (opposite the Chevron mini -mart) which itself is soon to be "upgraded" into an expanded Shell Oil gas station, car wash and (you guessed it)— mini mart. As they say on TV, "Wait, there's morel" Just to the Hilo side 10/30/00 • • Page 2 of 2 , of the police station'intersection in Waimea (about two blocks from Church Row), the same Maui developer who says he wants to add yet another gas station/mini -mart beside church row is ALREADY operating (4) a Shell Oil gas station/ MINI MART franchise. Additionally, we have learned that only slightly further out of town in the Hilo direction, near Kamuela Liquors, there is still ANOTHER (5) gas station (and mini - mart ?) being planned. As an experienced entrepreneur and business operator, it fascinates me that (after a self- imposed "time out "), the Maui developer is putting on such a big show of wanting to go ahead with his Church Row gas station/mini -mart #5 in our tiny town. I find it VERY difficult to believe that this developer really has serious intent of actually doing this project — as the division of business among so many very similar entities in such a small area will only reduce all their revenues, such that several must fail or become marginal players. Either the Maui "gentleman" doesn't know the first thing about business projections or competitive analysis — or he is conducting a not -very- subtle charade, presumably for the purpose of jacking up the price of the lot next to Church Row that he bought, I must hazard a guess here, speculatively. Were this interpretation of this "gentleman's" intent shown to be true, then he would have to be be seen as essentially "holding up" for ransom the town of Waimea, its citizens, and its various cultural and religious groups. Perhaps "clever," but definitely despicable. I cannot state that I know this to be the case. But my business experience tells me that unless this "gentleman" is VERY dumb indeed, he really can't want to dilute his existing business by overbuilding in the form of gas station / mini -mart "number five." And, if my hypothesis re: his intentions and motivations were to turn out to be true, then this "gentleman" would ALSO be holding up for ransom YOUR office and function, which I do not find to be a particularly respectful use of our county servants' time, expertise or energy. As you can tell, I am extremely annoyed by the apparent greed and small - mindedness of such speculators. This "gentleman" is NOTABLY neither a resident of Waimea nor of our county. (A "new Maui type "). I believe this entire application offers us all a rich opportunity to send a message to this type of opportunistic player: "hey pal, such (hypothetical) shenanigans are not welcome on our Island." I urge you to consider the following: The Waimea community, of which I have been a member for 24 of the last 31 years, has spent many, many hours during those years discussing the special ambience of our town, its future needs and its appeal to residents and tourists alike. The Waimea Design Plan was prepared and adopted by the community to guide future growth. Much of the Plan concerns the appearance of our town. Recently, there was tremendous public input to make sure the refurbishment of our main street was designed to be as attractive, safe and user - friendly as possible. The Lindsey Road /Kawaihae Road intersection realignment is underway which has also generated much community interest as it involved the cutting of mature trees and the realignment of an existing rock wall. There are many residents who are actively involved in maintaining and improving the natural beauty and character of our town through volunteer efforts. The Nature Park just off Ahuli Circle, and Waimea Trails and Greenways, and the annual Cherry Blossom Festival are but three examples. Tremendous community effort and support has gone into planting, maintaining and publicizing the stand of cherry trees along Mamalahoa Highway that greet visitors and provide a lacy foreground for Church Row. We are blessed with a lovely expanse of passive buildings and green hills at the entrance to Waimea town. And now we are faced with another attempt to lessen the beauty of one of the most pleasing aspects of our town. Church Row will be far less appealing with the constant traffic, unsightly advertising, tall signs and bright lights that always accompany the kind of gas station /convenience stores you propose. I hope the Big Island Planning Commission recognizes the community's efforts, involvement and public voice to keep our town attractive and avoid the helter - skelter building that has happened elsewhere on this island. How many gas stations does Waimea need? At current count there are four and waiting lines are non - existent. I implore the Planning Commission to be sensitive to Waimea residents' input into the Waimea Design Pia rhaps because you are not a resid4Of Waimea, you are not aware of the impact yo r development would have on our town. Please be sensitive to one of the most lovely parts of Waimea. Yes, commercial property rights do exist. But have we host all sense of community and what is appropriate? Could the last vacant piece of Church Row property not be dedicated to a more passive use? Could it not be rezoned to prevent a 24 -hour brightly lit eyesore from littering the entrance to Waimea? And what will be the impact of noise, traffic, light and chemical pollution on the hospital across the road or the sleeping observers at Keck observatory next door? We urge you to work with our community to find an alternative to adding a 24 -hour gas station /minimart to Church Row. The letter in the paper led me to a Web site that explained what you are proposing to do and I felt that I had to at least say something. As these things go I am sure that at this point short of a Major earthquake or the Volcano blows up the island, you are going to build this thing so chances are this letter will wind up in the "to little to late" file. Still I have to ask you, is that it then? Will you and other land owners and developers just turn the Big Island into yet another over crowded "Tourist Attraction ". Has the Big Island been sold and parceled out to a handful of rich and greedy people that don't even understand what this island is all about? Is there anyway to get you to change your mind? At the June 1 forum in Waimea, we listened to their proposal and waited to see the plans they would put forward. They promised to construct a facility that would be attractive, nicely landscaped, and a benefit to the community. We were disappointed to see that their current plans fall far short of their promises. The gas station /convenience store /car wash they propose is completely inappropriate for the proposed site. We feel it would be a grave error for the county to approve their plan, and urge you to oppose this development because it threatens to ruin a special place of great natural beauty. When my family and I moved to Waimea, it was in large part because of its charm and beauty. We are building a home not far from the proposed construction site and hope to live in Waimea for many years to come. We have designed our house to be an asset to the town and to complement its natural surroundings; although we are not legally required to do so, we feel a moral obligation to act responsibly. In contrast, the proposed gas station would be a major detriment to our community. The intended site is in the scenic heart of town, adjacent to historic churches and a notable cherry tree grove. To build the proposed gas station at this spot will irrevocably mar central Waimea with an ugly building and associated noise. It will be a rude slap in the face to those who appreciate the beauty and tranquility of our town if the present owners are allowed to build it as they intend. • P. O. An additional site for a gas station has been put forward beside Goodyear located on the same side of highway 19, a quarter mile further out of town. The landowners Richard and Sandy White are considering submitting an application for plan approval to the County of Hawai'i Planning Dept for a gas station with liquor license, convenience store and automatic carwash which does not exist at any of the other gas stations in town. In my opinion the community would support your endeavors to work with them on this alternative site. Six 24 hr. gas stations would be a lot for Waimea town. Your existing 23,000 sqft. lot is not conveniently located for those of us living on that side of town and travelling daily to Hilo. RUMORED GAS STATION AND CONVENIENCE STORE ON VACANT LOT BETWEEN CHURCH ROW AND KECK OBSERVATORY Waimea Community Association (WCA) learned of a proposed gas station and convenience store to be developed on the vacant lot fronting Mamalahoa Hwy - between Church Row and Keck Headquarters. We first heard rumors about this possibility last year and expressed our concerns then. We have had preliminary conversations with the proposed developer and hope to come to an agreeable solution; many consider the proposed use inappropriate. WCA regularly meets and works with landowners, developers, businesses and residents to try do what's best for the good of all of the community. We have great respect for property rights and creative entrepreneurial endeavors. We also respect the historic, scenic and cultural nature of our town and have attempted to identify and define these unique characteristics and values in our Waimea Design Plan. Following are some of the specific issues and concerns expressed by community residents, churches, organizations and landowners regarding a gas station at Church Row. These include - but are not limited to: * A major increase in traffic on Church Row Drive, which is a seriously substandard County road; * Safety issues over access /egress onto Mamalahoa Highway on a high traffic curve which is across from the new emergency access road used by all ambulance traffic to North Hawai'i Community Hospital; * Aesthetic impacts on one of the most beautiful landscapes on the Big Island -- an area distinguished by dozens of flowering cherry trees, architecturally significant churches, and back - dropped by tree - shrouded pu'u; * Bright lights -- perhaps all night long -- in an area that is still relatively free of light pollution. * Noise impacts on both passive Cherry Blossom Park and the daytime sleeping quarters at Keck headquarters for visiting astronomers; * Prospects of people parking and drinking in Church Row Park and on adjacent church property and residences; * Visual blight on an area dedicated to the community's Japanese heritage and traditions. As you may know, every tree in Cherry Tree Park is dedicated to an individual or organization who has made a significant contribution to this community; * Liquor sales within yards of five churches including the second oldest Christian church on the Big Island -- Imiola Congregational Church -- which was built by the late Rev. Lorenzo Lyons in 1855. We realize the property has commercial zoning and with this certain inherent development rights. We hope to be able to work with the developer to try to do the right thing both for business interests and the community of Waimea. Especially in a town that already has four gas stations! Although I am not a resident of Waimea, I work full -time in Waimea, shop and attend community events in Waimea, and I own a home in Waikoloa, so I am very concerned about the future development of the Church Row area. It is a unique and cherished part of Waimea for many island residents because of the long - established churches and the cherry trees that have been planted in memory of members of many local families. The park, which is the center of the area, is a quiet oasis where one can spend time meditating and savoring the view of the quaint old churches and the beautiful pu'us behind them. Families with children live adjacent to the area and many families' loved ones are buried in the nearby cemetery. Nearby, the W.M. Keck Observatory has developed an office complex that maintains the quiet distinction of the area. And, the North Hawaii Community Hospital across the street continues the theme of well thought -out development that has enhanced the community, and is becoming a world- renowned center for health and well- being. All of this development has maintained a low -key, non - invasive modernization of the surrounding parcels. When one looks at the history of the area and the beauty and solitude the area provides for island residents, the proposed 24 -hour gas 5/29/00 Page2of2 • station/convenience store in the Church Row area doesn't fit into the picture. With the proposed development would come increased traffic, pollution (air, noise, and light), and sale of liquor within a few hundred feet of churches and families' residences. Residents of the area would have to endure 24 -hour activity, lights, and noise - I don't believe that any of us would appreciate that intrusion into our peace and quiet, especially for our families. Also, W.M. Keck Observatory's astronomers' daytime sleeping quarters lie adjacent to the area and would be affected by the additional traffic and noise in the area during the day. The question that comes to my mind is "Why does Waimea need another gas station ?" It seems that the gas station less than a half mile east of the area, plus the Chevron and Shell station less than a mile in the other direction should provide adequate fueling potential for people traveling Mamalahoa Highway. Also, the Chevron station and the Shell station just east of the area have food and snacks available for patrons. Wouldn't some other use of the parcel be more conducive to the area? A medical office or a low -key business such as a health -food store or coffee shop would be more fitting to the area and the healthy lifestyles of the community. These uses would provide the community with more desirable services that would enhance the mellow, but distinctive down -home feeling of the Waimea area, plus, they would seem to be more respectful of the history and families in the area. Last time I gave testimony before the County Council was regarding Church Row Park in Waimea 8 years ago. At that time the County was proposing to make a soccer field with a chain link fence instead of our Cherry Blossom Tree Park. As President, I spoke on behalf of Waimea Outdoor Circle to save this beautiful place that is revered by our town. Also giving testimony at that time were representatives from the churches, Lions Club, other organizations as well as individuals from the community. We were successful in saving our Church Row Park. We came together as a community and started the Annual Cherry Blossom Heritage Festival so that this peaceful, beautiful, and sacred place would be appreciated and kept out of harms way. ' In our community, the 2 foremost landmarks that give Waimea it's sense of place are Hoku'ula (Buster Brown Hill) and Church Row, with it's Cherry Blossom Park. Even those of us who are not members of the congregations of churches surrounding the park are touched deeply by the serenity of this cherished place. Attending weddings and funerals of family and friends in an atmosphere uncluttered by gas stations, fast food and car washes is a way of life in Waimea. The road at Church Row is sub standard and it works perfectly for our purposes, keeping traffic slow and safe. At times the park overflows with cars parked with friends and neighbors paying our respects. This is as it should be for this area. Keck Observatory (WMKO), whose headquarters abuts the lot owned by Nanea, Inc. on Mamalahoa Highway in Waimea, regarding the proposed development of a 24 -hour gas station and convenience store on that property. I am hoping that you can be persuaded that this is an inappropriate use of that property given that it is surrounded by some of the most peaceful activities in Waimea —those of the North Hawaii Community Hospital (NHCH), of the churches on Church Row, and of the Observatory itself —and that you will seek some more benign development there. While I cannot speak for our neighbors, I will express to you my specific concerns from the perspective of the Observatory, which, along with NHCH and the Parker Ranch is one of the three principal employers in Waimea. The Keck Observatory Waimea facility is used to support the operations of the world's two largest telescopes, which are located on the summit of Mauna Kea. In many ways this property is similar to that of a small school campus - -we often refer to ourselves as such - -and some 75 scientists, engineers and support personnel have their offices on the Keck campus. In addition to our daytime efforts in support of the telescopes and their instruments, the most important activity of the Observatory—like that of any observatory—takes place at night when astronomers from all over the world use our facilities to study some of the most exciting and awe - inspiring phenomena known —from the moons of planets in our own solar system out to objects more than 10 billion light - years away from earth. The very name "Keck" has become synonymous with cutting - edge, hi -tech scientific research at its best, and the discoveries made here from those of new planets around other stars to the most distant known galaxies and quasars in the Universe —have captured the imagination of the public and have been featured by print and electronic media throughout the world. Not a week goes by when some film crew or newspaper or magazine team does not request to visit Waimea or the Mauna Kea summit to bring the news of the latest discoveries at Keck to their watching, listening, or reading public. At Keck we have pioneered "remote observing," whereby our visiting astronomers, through fiber -optic and computer technology, run their experiments on the Keck telescopes atop Mauna Kea from rooms in our Keck campus offices, so nearly HEADQUARTERS: 65 -1120 Mamalahoa Highway, ICamuela, HI 96743 PHONE 808 - 885 -7887 • FAX 808 -885 -4464 • • �, every night of the year there are teams of astronomers working all night in our facility. At the end of their night, they sleep in the 10 -unit day - sleeper complex at the back of the campus. I am very concerned that the traffic, noise, and lights associated with a 24 -hour convenience store are incompatible with the peace and quiet that is so conducive to the reflection and thought that make the astronomy "enterprise" so successful at Keck. Traffic When Mamalahoa Highway was improved last year, the Keck Observatory went to considerable expense to have our main driveway realigned so that it is exactly opposite that of NHCH since the existing misalignment, which dated from the building of NHCH in 1995 -6, made turns across traffic extremely hazardous. We are also extremely cognizant of the fact that at the end of and sometimes during every school day, there is a steady stream of school children walking past the Keck driveways, and we regularly warn our employees to be extremely cautious if they must leave or return to the campus in their cars during those times. Those same children would walk past the driveway of the proposed gas - station/convenience store where the ingress and egress of vehicles would be many times the small number that come in and out of the Keck campus. I would be extremely concerned for their safety in light of the increased traffic such a facility would bring. Noise As I have mentioned, by its nature our enterprise is one that needs a quiet environment in which our employees can think and study. The silence we normally associate with a library is the environment we try to maintain on our campus. Many of our employees keep their windows open during working hours to enjoy the wonderful Waimea air, and, except for those offices now facing Mamalahoa Highway, it is still possible to do so with no significant increase in noise pollution. Were a convenience store to be built immediately east of us, the increased traffic noise would almost certainly preclude those on that side of our building from working in that manner ever again. This would be a very unfortunate degradation of the quality of our work environment. We further understand that Nanea, Inc. may apply for a liquor license, a prospect we view with great alarm. Were liquor to be sold, it seems highly likely that many buyers would choose to consume liquor on the premises themselves or on those nearby. This would impose both a security and a noise hazard to the entire Keck campus, and we will certainly not support a liquor license application should one be submitted. Lights It is my understanding that the relatively new gas station/convenience stores in Waimea and Kawaihae are possible examples of what is being considered for Church • Row. I would suggest that should this project go forward these be considered as examples of how such a complex should not be built, especially with regard to the amount and type of lighting and shielding used. The Big Island has in place a lighting ordinance designed to protect its $40 -50 million/year astronomy industry from light pollution. There is some question whether either of the above- mentioned facilities complies with that ordinance, and we must be certain that any future such facilities are in full compliance. Furthermore, the trend has been to over - illuminate such facilities far beyond what is necessary, as is the case, in my opinion, with both of those facilities. We must do everything possible to protect the dark skies above the Big Island that make Mauna Kea the northern hemisphere's premier observatory site, not to mention protecting those same skies for the many Waimea residents who enjoy evening strolls under one of the most magnificent celestial canopies anywhere —a canopy that is lost in the glare of bright lights. The Illuminating Engineering Society of North America recommends that service station canopy lighting be designed to produce 5 — 10 foot - candles of illumination on the ground. Should it be helpful to you, engineers at the Keck Observatory could be made available to assist the designers of any such facility, whether on Church Row or elsewhere, to select appropriate lighting fixtures and proper shielding to produce that level of illumination. In closing, I repeat my concern on behalf of the Keck Observatory, and urge that you reconsider your plans for a 24 -hour gas station/convenience store as being inappropriate for this unique, peaceful setting. Keck Observatory whose administrative headquarters, which we fondly call our campus, is located in Waimea just west of Church Row and just across the street from the North Hawaii Community Hospital. I am here to express my support for Councilman Elarionoff's resolution requesting that the County Planning Director reject the plan to build a 24 -hour gas station/convenience store immediately east of our campus. The Keck Observatory is one of the three major employers in Waimea, and every day roughly 75 scientists, engineers and support personnel work at our facility to support the world's two largest telescopes atop Mauna Kea. Ours is a quiet, contemplative enterprise, in keeping with that of our neighbors, and helps give this end of Waimea its unique peaceful character. Our work continues all night as well, as data from the Keck telescopes are transmitted from Mauna Kea to laboratories on our campus where astronomers from all over the world come to study the Universe. After their all -night sessions, they sleep in the 10 -unit day - sleeper accommodations on our campus. The traffic, lights and noise associated with the proposed gas station/convenience store would thus be detrimental to the peaceful enterprise that goes on 24 hours a day right next door. Nearly 3 years ago, I was one of 8 panelists in a round -table discussion sponsored by Waimea Main Street asked to share their mana'o about Waimea's future. I was then a relatively new Waimea resident, and I remember having said something like "You have a unique place here; beautiful, peaceful — almost too good to be true. But it strikes me as extremely fragile. It would take only one bad planning decision, one mis- step to start this beautiful town down a path from which it might never recover." I stand here today with my own words ringing in my ears. A convenience store on Church Row feels like the first step down that path of no return. Two weeks ago, I met in Oakland with the Board of Directors of the Keck Observatory and persuaded them to pledge $270,000 of Observatory funds towards the purchase of the lot in question. We have subsequently asked Waimea community leaders to help us find matching funds within the community so that we can purchase the lot. We have no immediate plans to • • expand our campus, but at least if we could purchase the lot, we could assure that something more appropriate than a gas station/convenience store is eventually built there. But raising such funds will take time, and unless the construction of the gas station/convenience store is rejected or delayed, such funds, even if located quickly, will come too late. Once the bulldozers have begun to clear the land, there will be no turning back. Waimea is a fragile place. What a tragedy it would be if we were to knowingly allow it to be damaged beyond repair. Keck Observatory !J 002 • • ®, • October 31, 2000 County Counsel and Planning Department To the members of the committee: My husband and 1 are appalled to hear that the developers of the proposed Gas Station/Convenience Store, and now Car Wash, on Church Row have resubmitted their request to the planning department. We are hoping that our County Planning Department will see that this area, although zoned villagefcommerciat, is not the appropriate location for this type of business. There are many reasons why their request should be denied and we are very sure that you've heard them all. We are hoping that the voices of many will be heard and that you too will come to the same conclusion as our community has. The impact that such a business will have on the entire area is so obvious to everyone, that it amazes us how the owners of this property can, without conscious, resubmit their original request and yet add a car wash to it. Church Row is a beautiful tranquil park area in the heart of Waimea which is enjoyed by so many people. It's one of the most beautiful locations in Waimea. We do not want to see that changed in such a dramatic way. It will cause a dangerous traffic flow, walking hazards for our children and for those enjoying the park like setting. Security will become a problem for the adjoining properties with loitering and an increase in noise and lighting. This is dearly not a good location choice for a Gas Station / Convenience Store / Car Wash. Our Lifestyles will be changed forever if this is allowed to happen. We understand that they have purchased a village/commercial zoned property and are within their rights to have °a" business there but they must, as a potential new member of our community, do what is best. Not for their new business alone, but for all of us in the community which they expect will support them and help them to become successful. If the entire community has made it very clear that they do not want a Gas Station / Convenience Store / Car Wash on Church Rqt then what more do they need to know? If it were half the community for It and half against it then that would be a different situation, but we are talking about the entire community. 600 signatures were counted on petitions in only 6 days! What does that say to them, or are they simply looking the other way? We have yet to meet one person in this community that is for building a Gas Station on Church Row. And yet they move forward. Are they sending us a message? They are trying 10 give us the impression that they care and are doing what they can to solve the problem, and we would like to believe that, but their actions are speaking much louder than their words right now. We don't think anyone is denying that they should have "a" business (and having it there Is fine) just not that particular type. They want our sympathy because they bought a village/commercial property for a very large sum of money, but it's hard to sympathize and be understanding when they were very much aware of the sale between Parker Ranch and Ed Rapoza before they finalized their own offer and yet they chose to pay almost double anyway. They have placed themselves in a bad situation and that is unfortunate, but it is not the communities fault and we all shouldn't have to suffer for it. There must be a way to fix this and I'm sure if they think real hard, they'll come up with something. In the meantime, we ask that you look at the intense impact approving their plans will cause all of us. Consider all of the reasons sent to you by the hundreds who wrote letters and signed petitions. Many people have worked diligently to communicate the overall feelings of our community to you and now it's up to you. To our Council Members, please consider the proposed Resolution for Church Row so that this will not happen again. The community of Waimea has been in strong and vocal opposition to the impending destruction of the Church Row area at the hands of developers. However, all of our efforts have brought little results. You, as the County Council, have the opportunity to accomplish a momentous goal: Protect the serene and fragile atmosphere of Church Row Park for future generations.. You also have the opportunity to right a wrong. The Minit Stop Company has come from Maui with a vision of making money, which is the goal of every business. However, they are willing to trample the splendor of Waimea to line their own pockets. This company has not only refused to listen to our community, they have acted in direct opposition to our input and desires. From the outset, I have expressed my opposition to this project, but the Minit Stop Company has used subterfuge and smoke screens to get this gas station in place. They claim to be a kamaaina company, but they certainly are not akamai when it comes to appreciating our community. Please don't let a company from another island who has no regard for the tranquil nature of our island come in and destroy our Park. This resolution will right a wrong so that properties adjoining Church Row will preserve the nature of this setting. You also have the opportunity to insure that Waimea will always have a place of peace and gathering for years to come. Across the street from the Park is the North Hawaii Community Hospital where people come for physical healing. On the town end of the Park is Keck Observatory where one can find knowledge of our past and future. All along the Park, you will find churches where people come for spiritual and emotional healing. May I ask you: How does a gas station fit into this setting? This resolution keeps the original spirit of Church Row in tact for future generations. You have the opportunity to fulfill this vision. You also have the opportunity to protect the land for generations to come. By voting for this resolution, you will protect the Cherry trees lining the Park. You will protect the children & families who live in the area and use the park. You will protect the rustic beauty that makes Waimea such • • . • who live in the area and use the park. You can tell your children and they can tell their children that you had a hand in creating a refuge in Waimea called Church Row Park. The Board members are very concerned with the following possible impact that the gas station - convenience store will have in the area: There may be a significant increase in traffic on Church Row Road, a seriously substandard county road. Driving on the road may become hazardous. With liquor sales within yards of our church grounds people may park and drink not only in Church Row Park but also in our church property. We may therefore have to fence off the church grounds to prevent unauthorized people from entering. There are safety issues over access/egress on to Mamalahoa Highway on a high - speed/high traffic curve across from the new emergency access road to North Hawaii Community Hospital. The traffic safety issue for many of our elderly members is in making a left turn into the Church Row Road to enter our church ground, especially with the increase in traffic. In an area distinguished by dozens of flowering cherry trees, architecturally significant churches, and backdropped by tree- shrouded pu'u, there will be an aesthetic impact on one of the most beautiful landscapes on the Big Island. The committee was unanimous in feeling that the proposed use for that property is inappropriate, and nearly unanimous in recommending that the proposal be denied. The committee does have an understanding of the need for fair treatment of developers but feels that the community should have a chance to correct this situation in some manner even if it means delays or other inconvenience to the developer. We recognize that the property is apparently zoned to allow this type of development. However, we feel that the unique character of the surrounding area that includes Church Row, Church Row Park, Keck Observatory headquarters, and the nearby hospital deserves to be protected from the degradation of environment due to the commercial and industrial uses proposed. The Waimea Design Plan shows the area to be public open space /park with some housing. We feel that it is in the best interests of the community to preserve the beautiful surroundings and view plane of this important protected historic site. This natural beauty has distinguished Waimea and made it a valuable attraction to visitors and settlers. Construction of the proposed tacky commercial structure will degrade this heritage permanently by creating a garish focus of interest and activity that is directly opposed to the intended character of the entire surrounding area. We feel that this is not in the best interests of Waimea or of Hawaii County and the Parks and Recreation Dept. to allow this degradation. We recommend for Denial of this application, or a Deferral of Action pending any changes resulting from the up- coming General Plan Revisions.
