Home My WebLink AboutRES 356 Draft 01 2008-2010 ZY oI N I COUNTY OF HAWAI' I :' -/ STATE OF HAWAI' I RESOLUTION NO. 356 10 A RESOLUTION AUTHORIZING THE EXTENSION OF THE PUBLIC SEWER FROM PUGHULIHULI STREET /ANE KEOHOKALOLE HIGHWAY INTERSECTION TO FUTURE MANAWALE`A STREET /ANE KEOHOKALOLE HIGHWAY INTERSECTION FOR FOREST CITY HAWAII KONA, LLC. WHEREAS, applicant Forest City Hawai`i Kona, LLC has requested to extend the sewer in accordance with section 21 -26, Hawai`i County Code to service parcel 7 -4 -021: 020, owned by FHT Kamakana, LLC: and WHEREAS, the sewer extension will be added to the County construction contract for the extension to Ane Keohokalole Highway (currently in construction); and WHEREAS, applicant Forest City Hawaii Kona, LLC will bear the full cost of the extension and will be eligible to exercise conditions under Section 21- 28(b)(1), Hawai`i County Code granting reimbursement to the applicant for 10 years after completion of the extension of all moneys for sewer charges collected by the County from other properties, if any, connecting to the extension provided the total of such reimbursement shall not exceed the cost incurred by the applicant to construct the extension; and WHEREAS, the Director of Environmental Management has recommended approval of the extension according to section 21 -27, Hawai`i County Code; and Attachment "A" is an application from Forest City Hawaii Kona, LLC, with a vicinity map as supporting documentation; and WHEREAS, sewer extensions are beneficial to the community by eliminating the need of alternative waste treatment options and reducing the amount of pollutants reaching the groundwater and the coastal waters, resulting in a cleaner, healthier environment; and WHEREAS, this sewer extension will provide capacity to handle the wastewater from parcels 7 -4 -021: 001, 002, 003, 021, and 023 in the future; and WHEREAS, section 21 -26, Hawaii County Code, requires that the council approve all sewer extensions; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the sewer extension to Manawale`a Street/Ane Keohokalole Highway Intersection for Forest City Hawaii Kona, LLC is hereby approved. BE IT FURTHER RESOLVED that the request of the applicant to be reimbursed for the cost of the sewer extension in accordance with Section 21- 28(b)(1) is hereby approved.
