RESOLUTION NO. 328 00
RESOLUTION AUTHORIZING THE GRANT OF A WATER LINE EASEMENT AT
KAAPOKO HOMESTEADS, SOUTH HILO, HAWAI'I, ISLAND, COUNTY AND
STATE OF HAWAII, TAX MAP KEY NO (3)2 -7 -05 TO CYRUS M. WAGATSUMA,
NAGATA FAMILY TRUST, DOROTHY D. PATAO AND JAMES R. KENNEDY
AND LINDA C. KENNEDY
WHEREAS, Chapter 2, Article 19, Section 2 -111, of the Hawai'i County Code
provides that the County Council may, by resolution approved by a majority of its
members, dispose of real property; and
WHEREAS, the County of Hawai'i is the owner of that certain homestead road
located at Kaapoko Homestead, South Hilo, Hawai'i , Island, County and State of
Hawai'i as shown on the enclosed tax map; and
WHEREAS, the Department of Public Works, Engineering Division, has issued a
conditional permit to the owners to install the waterline, to serve their water needs; and
WHEREAS, the owners are requesting the County of Hawai'i to grant a waterline
easement, subject, however, to revision to the County upon termination or abandonment
of the easement for the specific purposes for which it was granted; and
WHEREAS, an independent appraiser determined that the fair market value of the
waterline easement is $2,000.00 with and area of 6,231 square feet.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII, in accordance with Chapter 2, Article 19, Section 2 -111 of the
Hawai'i Code, that the County of Hawai'i authorizes a grant of an easement for the
installation of waterline to Cyrus M. Wagatsuma, Nagata Family Trust, Dorothy D.
Patao, James R. Kennedy and Linda C. Kennedy.

BE IT FURTHER RESOLVED, that the Clerk of the County of Hawai'i transmits
copies of this resolution to Robert Yanabu, Chief Engineer, Milton D. Pavao, Manager,
Department of Water Supply and Dixie Kaetsu, Director of Finance.

EASEMENT 1 FOR WATERLINE
BEING A PORTION OF THE COUNTY ROAD, REG MAP NO. 2447
AT KAAPOKO, DISTRICT OF SOUTH HILO, ISLAND AND COUNTY OF HAWAII
Beginning at a pipe set in concrete at a Northwesterly comer of this parcel of land,
also being the Northeasterly comer of Lot 11, a portion of Grant 5745 to John P. Jorge, the
coordinates of this point of beginning referred to Government Triangulation Station "ALALA" being
17,545.45 feet South and 748.70 feet West, thence running by azimuths measured clockwise from
True South:
1. 243° 26' 00" 1210.70 feet along Lots 7 -A, 6 -B, 5 and 8 of Grant 5742 to
Manuel D'Arruda, Sr., along the Northwest right -of-
way of the County Road;
2. 269° 30' 00" 11.38 feet along other land of the County Road;
3. 63° 26' 00" 1221.95 feet along same;
4. 165° 05' 00" 5.11 feet along same to the point of beginning and containing
an area of 6081 Square Feet, more or less.

AT KAAPOKO, DISTRICT OF SOUTH HILO, ISLAND AND COUNTY OF HAWAII
Beginning at the Westerly corner of this parcel of land, also being on the
Southeasterly boundary of Lot 6 -B, a portion of Grant 5745 to John P. Jorge, the coordinates of this
point of beginning referred to Goveuuuent Triangulation Station "ALALA" being 17,350.90 feet
South and 359.63 feet West, thence running by azimuths measured clockwise from True South:
1. 243° 26' 00" 5.01 feet along Lot 6 -B of Grant 5745 to John J. Jorge, along
the Northwest right -of -way of the County Road;
2. 330° 26' 30" 30.04 feet along other land of the County Road;
3. 63° 26' 00" 5.01 feet along Grant 5744 to Manuel Modeiros Chiquita;
4. 150° 26' 30" 30.04 feet along other land of the County Road to the point of
