Re: Operating Budget
The County of Hawaii has been awarded a $81,860 Domestic Violence Prosecution grant
from the Office on Violence Against Women STOP Formula Grant (VAWA), that is funded
by the American Reinvestment and Recovery Act (ARRA) of 2009. The grant monies,
being provided through the State of Hawai`i Department of the Attorney General, will fund
one deputy prosecuting attorney position for the vertical prosecution of misdemeanor
domestic violence and protective order crimes on Hawaii Island where the victim is an
adult woman. This project will sustain a deputy prosecuting attorney currently providing
this service.
Enclosed is a resolution to authorize the Mayor to enter into an agreement with the State
of Hawaii Department of the Attorney General for this grant.
Also enclosed is a bill for an ordinance amending the Operating Budget by appropriating
the $81,680 into the Domestic Violence Prosecution - ARRA grant account.
The Office of the Prosecuting Attorney, who wishes to immediately begin this program
within the grant time frame of July 1, 2010 to March 3, 2011, are requesting a waiver from
the Finance Committee and to have this resolution and bill heard at the next Council
meeting scheduled for July 8, 2010.

A. REQUEST:
1) Requesting a resolution authorizing the Mayor to enter into an agreement with the State Department of
the Attorney General to receive federal American Reinvestment & Recovery Act (ARRA) grant funds for the
Domestic Violence Prosecution project.
2) Requesting a bill for an ordinance to appropriate $81,680 for the Domestic Violence Prosecution - ARRA
project.
3) Requesting waiver of Finance Committee action to expedite approval process.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The County of Hawaii has been awarded grant funds from the Office on Violence Against Women STOP
Formula Grant (VAWA) funded by the American Reinvestment and Recovery Act (ARRA) of 2009. The grant
will provide one deputy prosecuting attorney to provide vertical prosecution of misdemeanor domestic

We are requesting waiver of Finance Committee action so that we can immediately begin this program within
the grant time frame, 7/1/10 to 3/31/11.

RE: Resolution No. 360 -10 : A Resolution Authorizing the Office of the Mayor to Enter
into an Agreement with the State of Hawai`i Department of the Attorney General, Pursuant
to HRS 46 -7, for the Domestic Violence Prosecution Grant Program
Bill No. 264 : An Ordinance to Amend Ordinance No. 10 -59, as Amended, the
Operating Budget for the County of Hawai`i for the Fiscal Year Ending June 30,2011
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above - referenced matter be
waived from the Finance Committee to the full Council for immediate action. In reviewing this
matter, timely approval is crucial. It is therefore advantageous that approval is granted and the
matter be placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Finance Committee
for placement on its future agenda.
