RESOLUTION NO. 361 10
RESOLUTION AUTHORIZING THE COUNTY OF HAWAII TO ENTER INTO A MULTI -YEAR
LEASE OF REAL PROPERTY FOR PUBLIC PARKING AND PARK IMPROVEMENTS IN
HOLUALOA 1ST, NORTH KONA, HAWAII, TAX MAP KEYS: (3)7 -6- 015:012 AND 013.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, Section 10 -11 of the Hawai`i County Charter requires that any contract, lease or
other obligation requiring payment of funds from the appropriations of a later fiscal year or of more
than one fiscal year shall be approved by resolution; and
WHEREAS, the Department of Parks and Recreation and the Department of Public Works
have determined that there is an immediate and pressing need for additional public parking and park
improvements along Ali`i Drive across from Banyan's Beach in Kailua -Kona; and
WHEREAS, the County administration wishes to enter into an eight (8) year lease, with year to
year options after that, with Karen A. Kobayashi, Trustee, for the use of the parcels identified as Tax
Map Keys: (3)7- 6- 015:012 and 013, in Holualoa 1st, North Kona, for use as a public parking lot and
park improvement areas, at a cost per parcel of $500.00 per month, for a total cost of $6,000.00 per
year, plus the exception of the parcels' real property taxes under Section 19 -84 of the Hawaii County
Code as property leased to the County of Hawaii.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that (1) the Mayor is hereby authorized to enter into a multi -year lease agreement for a
public parking lot and park improvements as described herein, pursuant to Section 10 -11 of the
Hawai`i County Charter; and (2) that sufficient funds be budgeted in future fiscal years to cover the
anticipated obligations of the County under the lease agreement.
BE IT FURTHER RESOLVED that a copy of this resolution be sent to (1) Mayor William P.
Kenoi; (2) Parks and Recreation Director Robert Fitzgerald; (3) Director of Public Works Warren
H.W. Lee; (4) Deputy Corporation Counsel Gerald Takase; and (5) Karen A. Kobayashi, Trustee, 76-
124 He'enalu Road, Kailua -Kona, Hawai`i 96740.
