Please place the attached resolution on the appropriate agenda for the Council Committees
meeting scheduled for July 20, 2010.
A Resolution to Seek the Opinion of an Attorney in the Private Sector on Whether
Hawai`i Revised Statutes Chapter 92, (Public Agency Meetings and Records)
Commonly Referred to as the "Sunshine Law," in its Present Form, Constrains the
Council from Effectively and Efficiently Performing its duties.
The attached resolution being submitted for consideration seeks an opinion of an attorney in the
private sector on whether Hawai`i Revised Statutes Chapter 92, commonly referred to as the
"Sunshine Law," in its present form, constrains the Council from effectively and efficiently
performing its duties and therefore be considered exempt from Hawai`i Revised Statutes Chapter
92, for the same reasons cited by the Hawai`i State Legislature.
