Your Committee on Public Works and Intergovernmental Relations, to which was referred
Resolution 351 -01, reports as follows:
Resolution 351 -01, transmitted via Communication No. 838 on June 7, 2010, from Deputy
Corporation Counsel Gerald Takase, authorizes and ratifies the amendment of the grant of non-
exclusive easement for limited public access over private roadways for temporary Mamalahoa
bypass through Hokuli`a phase I and Haleki`i Street, in the districts of North and South Kona,
Island, County and State of Hawai`i.
Laura Dierenfield of People's Advocacy Trails Hawai`i [PATH] testified in support but was
critical of the lack of bicycle and pedestrian right -of -way infrastructure in this plan, and pointed
out how this is inconsistent with the Community Development Plan.
Deputy Corporation Counsel Gerald Takase described the agreement process with Oceanside
1250 and their mainland lenders, in allowing the County to self - insure this length of road.
Councilmember Brenda Ford asked Department of Public Works Director Warren Lee about the
dedicative standards of the road project. She reviewed the remaining six out of an original list of
twenty -four mitigations required in the construction, and Mr. Lee and Mr. Takase feel the work
is progressing satisfactorily on all these items. Councilmember Kelly Greenwell shared the
proper pronunciation of the street is Haleki‘i, with the second "I being virtually silent.
Your Committee on Public Works and Intergovernmental Relations is in accordance with the
purpose and intent of Resolution 351 -10, and recommends its adoption.
