— Multiple polluted discharges occurred in Oct. 2000
— Pollution resulted from both natural and man - caused
sources but primarily from poor land management
practices and a lack of regulatory oversight
— DOH pursued informal enforcement actions but did not
assign responsibility for the sediment discharge to any
individual
A separate Enforcement action was taken by another
regulatory agency (EPA)
