Dear Chairman Yoshimoto and Council Members:
Re: Chapter 9 — Electrical Code
Transmitted herewith for the Council's consideration and approval is an ordinance
amending Chapter 9 — Electricity of the Hawai`i County code 1983 (2005 Edition, as Amended),
relating to the County Electrical Code.
On May 21, 2007, the Twenty -Fourth Legislature of the State of Hawai`i, with approval
from the Governor, under Act 82 required the adoption of a uniform set of statewide building
codes applicable to one and two family dwellings, all other residential uses, commercial and
industrial buildings, and state buildings that would make it possible for building owners,
designers, contractors and code enforcers within the State to apply consistent standards. This
Act took effect on July 1, 2007. The Act required the Department of Accounting and General
Services to establish and implement a State Building Code which is established by the State
Building Code Council. The Council is made up of nine voting members: one county building
official from each of the four counties; one state fire council; one from the Department of Health;
one from the Department of Labor and Industrial Relations; one from the Structural Engineers
Association of Hawai`i; and one from the American Institute of Architects. The Act requires the
Council to review and adopt, as appropriate, the new model building codes.
Since the start of the State Building Code Council, we have reviewed and proposed the
adoption of 2008 National Electrical Code (NEC) with amendments. Under the jurisdiction of
the State Building Code Council, the review process and adoption of the code has gone through
extensive advertised meeting with the general public and various design professionals and
organizations. Once approved by the Council, it had gone to regulatory approvals and publicized

public hearings. Finally, it had gone to the Governor for approval and signature. The effective
date of the 2008 NEC was April 16, 2009. The four counties have eighteen months from the
effective date to amend the State Building Code as it applies within their respective jurisdictions.
Otherwise, the counties shall use the state model code and standards listed in Section 107E,
Hawaii Revised Statutes, as the referenced model building code.
The 2008 NEC with amendments is submitted as it relates to the State Building Code,
with the exception of the administrative portion of the code which varies by each county. The
Electrical Code in Chapter 9 is amended with the following:
1. Revised Scope.
2. The definition "Administrative authority" is amended to read "Authority having
jurisdiction" (AHJ).
3. Addition of new definitions.
4. Amended Request for inspection
5. Amended Rain Water and Sea Water Flooding Standards.
6. Simplified Fee Schedule.
