Dear Chairman Yoshimoto and Council Members:
Re: Chapter 17 - Plumbing Code
Transmitted herewith for the Council's consideration and approval is an ordinance
amending Chapter 17 — Plumbing of the Hawai`i County Code 1983 (2005 Edition, as
Amended), relating to the Plumbing Code.
On May 21, 2007, the Twenty -Fourth Legislature of the State of Hawai`i, with approval
from the Governor, under Act 82 required the adoption of a uniform set of statewide building
codes applicable to one and two family dwellings, all other residential uses, commercial and
industrial buildings, and state buildings that would make it possible for building owners,
designers, contractors and code enforcers within the State to apply consistent standards. This
Act took effect on July 1, 2007. The Act required the Department of Accounting and General
Services to establish and implement a State Building Code which is established by the State
Building Code Council. The Council is made up of nine voting members: one county building
official from each of the four counties; one state fire council; one from the Department of Health;
one from the Department of Labor and Industrial Relations; one from the Structural Engineers
Association of Hawai`i; and one from the American Institute of Architects. The Act requires the
Council to review and adopt, as appropriate, the new model building codes.
Since the start of the State Building Code Council, we have reviewed and proposed the
adoption of the 2006 Uniform Plumbing Code (UPC) with amendment. Under the jurisdiction of
the State Building Code Council, the review process and adoption of the codes has gone through
extensive advertised meetings with the general public and various design professionals and
organizations. Once approved by the Council, it had gone to regulatory approvals and publicized

public hearings. Finally, it had gone to the Governor for approval and signature. The effective
date of the 2006 UPC was April 16, 2009. The four counties have eighteen months from the
effective date to amend the State Building Code as it applies within its respective jurisdictions.
Otherwise, the counties shall use the state model code and standards listed in Section 107E,
Hawaii Revised Statues, as the referenced model code.
The 2006 UPC with amendments are submitted as it relates to the State Building Code,
with the exception of the administrative portion of the code which varies by each county. The
Plumbing Code in Chapter 17 is amended with the following:
1. The definition "Administrative authority" is amended to read "Authority having
jurisdiction" (AHJ).
2. Gray Water System is amended by the Department of Health. Enforcement will be by the
Department of Health.
3. Appendix K - Private Sewage Disposal System is amended by the Department of Health.
Enforcement will be by the Department of Health.
