The Committee on Public Safety and Parks and Recreation, to which was referred Bill No. 210,
reports as follows:
Bill No. 210, transmitted by Council Member Brenda J. Ford, via Communication No. 709.4,
dated March 4, 2010, is an ordinance amending Chapter 7, Civil Defense, Article 2, of the
Hawai`i County Code 1983 (2005 Edition, as amended), relating to emergency water spigots.
This ordinance will regulate the use of emergency water spigots, adds and corrects definitions,
removes section 7 -8 on water hauling charges, establishes that non - emergency use of spigots is
for residential use only, delineates actions that are prohibited, set the maximum number of
gallons to be taken per occasion at 500 gallons, and assigns an appropriate penalty for violations
at not more than $500 or imprisonment for not more than 30 -days.
Communication No. 709.1, dated February 18, 2010, was transmitted by County Clerk Kenneth
G. Goodenow, as a housekeeping recommendation due to the inadvertently omitted words from
the end of the definition of "Impending disaster." This amendment does not change the bill or its
purpose.
Communication No. 709.2, dated February 22, 2010, was transmitted by Dennis "Fresh" Onishi,
Chairperson of the Committee on Finance, waiving Bill No. 210 to full Council for
consideration.
Communication No. 709.3, dated March 3, 2010, was transmitted by Council Member Guy
Enriques, providing a water spigot update, and stated that discussion with the Department of
Water Supply, Civil Defense, Department of Public Works, and Hunter Bishop, the Mayor's
representative with regards to updating the County's guidelines and procedures for the Water
Spigot Program are taking place.
Communication No. 709.3, transmitted by Council Member Guy Enriques, (no date specified),
relating to water spigot update for District 6.
On March 3, 2010, Bill No. 210 was amended to Draft 2 by the full Council via Communication
No. 709.1. Pursuant to council discussion, the Council voted to refer Bill No. 210, as amended
to Draft 2, back to the Committee on Public Safety and Parks and Recreation.

Communication No. 709.5, transmitted by J Yoshimoto, Council Chair, dated March 4, 2010,
requesting to place Bill No. 210, Draft 2, on the next scheduled Committee on Public Safety and
Parks and Recreation meeting.
Council Member Brenda Ford expressed the following concerns:
• Maintenance of water spigots
• Transfer of o from Civil Defense Department to the Department of Public Works
• Transfer of funds
• Penalty amount of $1,000.00
Civil Defense Administrator Quince Mento stated that maintenance of the water spigots will be
done by the Department of Public Works. He also stated that the funding will be transferred into
the budget for Public Works.
Mr. Quirino Antonio, Deputy Director of the Department of Water Supply stated that DWS will
maintain the waterline all the way up to the meter.
Public Works Director Warren Lee stated that his department will maintain the spigots and areas
around it.
Council Member Brenda Ford stated that the penalty of $1,000 in Section 7 -8 is inserted as a
deterrent to keep people from abusing the use of the spigots. The penalty amount in Section 7 -11
of the Hawaii County Code is for the enforcement of all other violations.
Your Committee on Finance forwards Bill No. 210, Draft 2 to Council with a negative
recommendation.
