COUNTY OF HAWAII - •'� " % �• STATE OF HAWAII RESOLUTION NO. 374 10 RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOTS 19, 20 and 21 OF THE SUNSET RIDGE AT WAIKOLOA, PHASE 2, INCREMENT 2, UNIT 2 -A, BEING TAX MAP KEY: (3)6 -8- 031:050, SITUATE AT WAIKOLOA, DISTRICT OF SOUTH KOHALA, COUNTY AND STATE OF HAWAII, FROM TRI OF WAIKOLOA. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. WHEREAS, Tri of Waikoloa is the owner of: Lot 19 Kualapa Place 10,318 sq. ft. Lot 20 Puwalu Street Ext 17,250 sq. ft. Lot 21 Mahuahua Place 10,318 sq. ft. identified as Tax Map Key: (3) 6 -8- 031:050, situate at Waikoloa, in the District of South Kohala, County and State of Hawai`i, as delineated on Exhibit "A" attached; and WHEREAS, Tri of Waikoloa has constructed all subdivision improvements and received final subdivision approval; and WHEREAS, Tri of Waikoloa is desirous of dedicating the above roadway lots, including all subdivision improvements thereon, to the County of Hawai`i for road and drainage purposes, and the improvements have been inspected and approved by the County of Hawai`i Department of Public Works, and received dedication approval from the Department of Water Supply, Planning Department and Department of Environmental Management; and WHEREAS, the subject roads and drainage improvements have been completed according to County of Hawai` i standards, and are in acceptable condition for dedication, and in full compliance with the provisions of Chapter 23 of the Hawai`i County Code; and WHEREAS, Section 23 -10 of the Hawai`i County Code prohibits the Council from receiving by dedication any streets in any subdivision platted after December 2, 1966 except upon full compliance with the provisions of Chapter 23; and WHEREAS, Article XIII, Section 13 -12 of the Hawai`i County Charter, provides that the council may accept gifts, which include the dedication of land, on behalf of the County of Hawai`i. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds the subject subdivision and improvements thereon are in full compliance with the provisions of Chapter 23 of the Hawai`i County Code as certified and approved by all applicable agencies. BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13 -12 of the Hawai`i County Charter, and Section 23 -10 of the Hawai`i County Code, that the County of Hawai`i accepts the dedication of: Lot 19 Kualapa Place 10,318 sq. ft. Lot 20 Puwalu Street Ext 17,250 sq. ft. Lot 21 Mahuahua Place 10,318 sq. ft. identified as Tax Map Key: (3) 6 -8- 031 -050, delineated on Exhibit "A" attached hereto, including all improvements thereon, for public road and drainage purposes. BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Mayor William P. Kenoi; (2) the Department of Public Works; (3) Deputy Corporation Counsel Gerald Takase; and (4) Stephen J.
