RESOLUTION NO. 382 10
RESOLUTION ACCEPTING THE GRANT OF EASEMENT FROM KAILUA KONA
VILLAGE DEVELOPMENT GROUP, LLC FOR TRAFFIC SIGNAL LIGHT POLE
PURPOSES.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, KAILUA KONA VILLAGE DEVELOPMENT GROUP, LLC is the owner
of Tax Map Key: (3)7 -5- 007:021, situated in Kailua, District of North Kona, County and State of
Hawaii; and
WHEREAS, the County of Hawai`i would like to install a traffic signal at the corner of
Ali`i Drive and Hualalai Road; and
WHEREAS, Kailua Kona Village Development Group, LLC is desirous of granting the
County of Hawai`i an easement, which easement is more particularly delineated on Exhibit "A"
attached hereto as Easement 4; and
WHEREAS, Article XIII, Section 13 -12 of the Hawai`i County Charter, provides that the
Council, on behalf of the County of Hawai`i, may accept gifts or donations of money, securities
or other personal property or of real estate or any interest in real estate.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Article XIII, Section 13 -12 of the Hawai`i County Charter, the
County of Hawai`i accepts the grant of Easement 4 delineated on Exhibit "A" attached hereto,
from Kailua Kona Village Development Group, LLC.
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Mayor
William P. Kenoi; (2) Director of Public Works Warren H.W. Lee; (3) Deputy Corporation
Counsel Gerald Takase; and (4) William J. Kimi, Jr., Manager, Kailua Kona Village
Development Group, LLC, 75 -5744 Ali`i Drive, Suite 286, Kailua -Kona, Hawai`i 96740.
