RESOLUTION NO. 391 10
A RESOLUTION AUTHORIZING THE COUNTY OF HAWAII TO ENTER INTO
NEGOTIATIONS FOR A MULTI -YEAR LEASE OF REAL PROPERTY FOR A
PUBLIC SWIMMING AREA AT POHOIKI, IN THE DISTRICT OF PUNA,
ISLAND, COUNTY AND STATE OF HAWAII, IDENTIFIED AS TAX MAP KEY:
(3)1 -4- 002:009.
WHEREAS, Hawai`i is famous for its beaches and swimming areas and yet two decades
ago, Harry K. Brown Beach Park in Kalapana was covered by lava and as a result there are very
few places to access the ocean on the east side of Hawai`i Island; and
WHEREAS, the limited access to the shoreline has turned Pohoiki, the second busiest
boat ramp in the State, into the primary spot for swimmers who are forced to compete with
boaters and surfers in order to access the ocean; and
WHEREAS, for health and safety reasons, we need to alleviate this stressful situation, as
all these marine activities coming together is a formula for accidents and mishaps; and
WHEREAS, the County of Hawai`i is interested in creating more public swimming
recreational areas in the Puna region; and
WHEREAS, the County of Hawai`i has identified a 21.30 acre parcel located at Pohoiki
in Pahoa, Hawai`i that would be ideal for a public swimming hole; and
WHEREAS, Ku'ulei Kealoha Cooper Springer, Trustee of the Kealoha Estate, owns
the 21.30 acre parcel in Pohoiki in Pahoa, Hawai`i (TMK: (3)1 -4- 002:009), which contains
ocean accessed swimming ponds on the property; and
WHEREAS, the 21.30 acre parcel is located on a main road making it an easy place for
the public to access (not a long hike), and there is a gradual entrance into the water making it
especially safe for the keiki; and
WHEREAS, an ocean accessed swimming hole replenished by moving, fresh water
makes it a more fun, naturally beautiful, and different environment compared to a chlorinated
swimming pool; and
WHEREAS, the County of Hawai`i would like to enter into negotiations for a
ninety -nine (99) year lease and /or Memorandum of Agreement (MOA) with Ku'ulei Kealoha
Cooper Springer for 21.30 acres of her Pohoiki coastal property, in order to create this public
swimming area; and
WHEREAS, a negotiated lease agreement and /or MOA will be subject to obtaining the
necessary external funding to construct the public swimming area; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
administration of the County of Hawai`i is authorized to enter into negotiations for a ninety -nine
(99) year lease and /or Memorandum of Agreement (MOA) with Ku'ulei Kealoha Cooper
Springer to lease 21.30 acres of land, identified as TMK: (3)1 4- 002:009, to create a public
swimming area in the Pohoiki area.
BE IT FURTHER RESOLVED that, pursuant to Section 10 -11 of the Hawai`i County
Charter, which requires that any contract, lease or other obligation requiring payment of funds
from the appropriations of a later fiscal year or of more than one fiscal year shall be approved by
resolution, a subsequent resolution containing the negotiated terms shall be submitted to the
council for its consideration.

BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to (1) the Honorable Mayor William P. Kenoi; (2) the Director of the Department of
Parks and Recreation; (3) the Director of the Department of Finance; and (4) Ku'ulei Kealoha
Cooper Springer, Trustee.
