Your Committee on Planning, to which was referred Bill No. 284 reports as follows
Bill No. 284, transmitted via Communication No 904 from Mayor William P. Kenoi, dated
July 28, 2010, presents a Change of Zone Request by Stephanie Dullum, at Kawela, Hamakua,
Hawaii, covered by Tax Map Key 4 -6 -011 039
Bill No 284 seeks to amend Section 25 -8 -16 (HAmakua District Homestead Area Zone Map)
and Section 25 -8 -7 (North and South Kohala District Zone Map), Article 8, Chapter 25 (Zoning
Code) of the Hawaii County Code 1983 (2005 Edition), by changing the district classification
from Agricultural — Forty Acres (A -40a) to Agricultural — Ten Acres (A -l0a), for an area of
approximately 71.178 acres.
There was no public testimony. Applicant was represented by Mr Sidney Fuke and
Mr. Bob Hogan, both of whom were present at the meeting.
Mr. Fuke informed your Committee that the property was planned to be divided into a total of six
smaller agricultural parcels approximately 10 acres in size. Mr Fuke further informed your
Committee that there is one county meter for the current parcel, and that this is not an adequate
source of water for the subdivision. Mr. Fuke stated that the applicant has drilled a well on the
subject property to provide water for the planned agricultural purpose for the properties The
well has been estimated to provide 15,000 gallons of water per day, which will more than
adequately provide water for the six parcels Additionally, the applicant will drill a secondary
well, with reservoirs or other appropnate storage method for water storage, ensuring that there
will be sufficient water for all lots.
Mr. Fuke also informed your Committee that the applicant is voluntarily relocating the access
point from the Hawaii Belt Highway to a location that will be, at a minimum, 880 feet from the
existing Kapuna Road and Hawai`i Belt Highway intersection.
Council Member Donald Ikeda, Chair of your Committee asked that he be allowed to
temporarily step down as Chair in order to introduce an amendment to Bill 284. Planning

Committee Vice -Chair Guy Enriques assumed the role of Chair of your Committee during the
further discussion of this matter.
Council Member Donald Ikeda moved to amend Bill 284 with the contents of Communication
904.1, wherein the applicant's voluntary changes would be codified. Council Member Emily
Naeole- Beason seconded the motion. Voting in favor of the amendment were Council Members
Ford, Hoffmann, Ikeda, Naeole- Beason, Onishi, Yagong, Yoshimoto and Enriques. Council
Member Greenwell was not present to vote on the motion.
Your Committee concurs with the Windward Planning Commission's and the Planning
Director's favorable recommendation for approval of the Change of Zone request.
Your Committee on Planning is in accord with the purpose and intent of Bill No. 284, as
amended to Draft 2, and recommends it pass first reading.
