No. 943/Bill No. 300 PLACE: Sheraton Keauhou Bay Resort & Spa 78 -128 Ehukai Street Kailua -Kona, Hawaii TIME: 2:00 p.m. Council Chair and Members Hawafi County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 300, reports as follows. Bill No. 300, transmitted via Communication No 943 from Mayor William P Kenoi, dated August 12, 2010 presents a Change of Zone Request by MEN Real Estate Investment, Inc , at Halekii and Kanaueue, South Kona, Hawaii, covered by Tax Map Key. 8 -1- 025.011 Bill 300 seeks to amend Section 25 -8 -4 (South Kona Zone Map), Article 8, Chapter 25, (Zoning Code) of the Hawaii County Code 1983 (2005 Edition), by changing the district classification from Single Family Residential — 15,000 square feet (RS -15) to Neighborhood Commercial — 20,000 square feet (CN -20), for an area of approximately 3 671 acres There was no public testimony Applicant was represented by Mr. Sidney Fuke and Mr Ali Ghalamfarsa, both of whom were present at the meeting Mr Fuke and Mr. Ghalamfarsa informed your Committee that the property was planned to be used for offices, a pharmacy, medical laboratory and possibly an urgent care medical office Mr Ghalamfarsa also informed your Committee that the applicant intends to seek LEEDS certification for the project (a green building rating system known as "Leadership in Energy and Environmental Design ") Council Member Brenda Ford stated that she met with Mr Fuke prior to this meeting, and that she and Mr. Fuke discussed the changes that she wanted to be made in order for her to approve this request. She then told Mr Fuke to inform your Committee members of the applicant's intended mitigation for her many concerns regarding the project. Mr Fuke informed your Committee that the applicant will be making numerous concessions and alterations to their plans in order to accommodate Ms Ford's concerns, including improvements to Haukapila Street, improvements to an existing eucalyptus grove, traffic signahzation at the intersection of Halekaupila Street and Halekii Street, wastewater systems, fencing and installation of photovoltaic units. PC Report No 96 PC Report No. 96 Comm. 943/Bill No. 300 September 20, 2010 Page 2 Ms. Ford informed your Committee that Mr. Fuke will be preparing the amendments to Bill No. 300, which reflect the changes needed in order to accommodate her concerns, and she will submit them. Ms. Ford then moved to postpone this matter until the next committee meeting in order for her to take the amendments to "the neighbors" for their approval. Council Member Donald Ikeda, who had asked to be allowed to step down for this meeting in order to fully participate in the discussions regarding various agendized items, stated that he opposed the postponement since Ms. Ford has had ample time to take the amendments to "the neighbors ". Council Members Ford, Hoffmann and Naeole- Beason voted in favor of the postponement. Council Members Onishi, Yoshimoto, Ikeda and Enriques voted against the postponement. Ms. Ford's motion failed. Your Committee concurs with the Leeward Planning Commission's and the Planning Director's favorable recommendation for approval of the Change of Zone request.
