STATE OF HAWAII 7tE Gf •N'i _:' RESOLUTION NO. 393 10 RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOTS 149 THRU 155 OF KILOHANA KAI AT WAIKOLOA PHASE II, BEING TAX MAP KEYS: (3)6 -8- 035:052 AND 6 -8- 040:108, SITUATE AT WAIKOLOA, DISTRICT OF SOUTH KOHALA, COUNTY AND STATE OF HAWAII, FROM THE ASSOCIATION OF OWNERS OF KILOHANA KAI AT WAIKOLOA, PHASE II. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. WHEREAS, the Association of Owners of Kilohana Kai at Waikoloa, Phase II, is the owner of: Lot 149 Kokee Street/Kokee Place 31,458 sq. ft. Lot 150 Haena Street 24,795 sq. ft. Lot 151 Eleele Place 27,237 sq. ft. Lot 152 Haia Street 138,423 sq. ft. Lot 153 Halepua Street 27,083 sq. ft. Lot 154 Haena Street 94,441 sq. ft. Lot 155 Haena Place 13,008 sq. ft. identified as Tax Map Keys: (3) 6 -8- 035:052 and 6 -8- 040:108, situate at Waikoloa, in the District of South Kohala, County and State of Hawai`i, as delineated on Exhibits "A" and "B" attached; and WHEREAS, the Association of Owners of Kilohana Kai at Waikoloa, Phase II, has constructed all subdivision improvements and received final subdivision approval; and WHEREAS, the Association of Owners of Kilohana Kai at Waikoloa, Phase II, is desirous of dedicating the above roadway lots, including all subdivision improvements thereon, to the County of Hawai`i for road and drainage purposes, and the improvements have been inspected and approved by the County of Hawai` i Department of Public Works, and received dedication approval from the Department of Water Supply, Planning Department and Department of Environmental Management; and WHEREAS, the subject roads and drainage improvements have been completed according to County of Hawai`i standards, and are in acceptable condition for dedication, and in full compliance with the provisions of Chapter 23 of the Hawai`i County Code; and WHEREAS, Section 23 -10 of the Hawaii County Code prohibits the Council from receiving by dedication any streets in any subdivision platted after December 2, 1966 except upon full compliance with the provisions of Chapter 23; and WHEREAS, Article XIII, Section 13 -12 of the Hawai`i County Charter, provides that the council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds the subject subdivision and improvements thereon are in full compliance with the provisions of Chapter 23 of the Hawai`i County Code as certified and approved by all applicable agencies. BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13 -12 of the Hawaii County Charter, and Section 23 -10 of the Hawai`i County Code, that the County of Hawaii accepts the dedication of: Lot 149 Kokee Street /Kokee Place 31,458 sq. ft. BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Mayor William P. Kenoi; (2) the Department of Public Works; (3) Deputy Corporation Counsel Gerald Takase; and (4) Eric Soto, President, Association of Owners of Kilohana Kai at Waikoloa, Phase II, 931 University Avenue, Suite 105, Honolulu, Hawai`i 96826.
