These documents clearly indicate that more than just grubbing has occured. This is just one more example of a person or persons involved in the Woodlands Center project purposely and willfully making, what I believe to be, untrue claims in their alleged attempts to circumvent county law, and also the authority of the County Council. The owner /develper were notified in writing in Dec. 2009 that their zoning had expired. Mr. McElvaney later claimed to have filed for an extension "as soon as we realized we had gone past the deadline." (Records show his applcation for extension April 16, 2010). When it became evident to the owner /developer that there might be public opposition to the rezoning request, Woodlands attempted to circumvent the Council's authority by illegally seeking a Certificate of Occupancy through Dept.(s) of Planning and Public Works. Most recently Mr. Ogasawara, when asked in no uncertain terms, if he would withdraw his "generous" out of his own pocket" "gift" of ( +/- )$400,000.00 for traffic mitigation measures REQUIRED BY LAW, if the County Council actually enforced the Concurrency Ordinance of the County Code, Paul acted as though he might do exactly that, withdraw "his" funds for these required traffic mitigation measures. As it turns out, Longs /CVS had allocated more than 3/4 of that funding for the express purpose of making sure these mitigation measures were completed before their scheduled Nov 1 opening date. So Mr. Ogasawara could not have withdrawn those funds even if he had wished to withdraw them. It is my opinion that the Woodlands folks, from the outset, have intended to ramrod this project through the County in the hopes that they could get their Certificate(s) of Occupancy, with little or no traffic mitigation, and later lay all of the associated expense of actual traffic mitigation, (to date,still not quantified),on the taxpayers doorstep, as well as the surrounding property owners. I may be mistaken in this opinion. But I believe the evidence and my personal experiences throughout this whole developement fiasco support this idea. In my opinion, Mr. Ogasawara is not the public benefactor that he has made himself out to be. Paul is a businessman. His motivation is profit, pure and simple. His actions are directed by what will best benefit Paul and Comm Ito. Ref. Tot 9/20/2010 Ref. Dote Paul's business interests. Page 2 of 2 It is my opinion that Mr. Ogasawara, or his agents or representatives have endeavored to mislead the County Council and the taxpayers, (and registered voters), of the County and State of Hawaii through their spoken testimony and through what they have chosen not to disclose through their testimony. Their alleged actions demonstrate the intent to achieve their ends no matter what the cost in public safety, so long as the financial burden can be sloughed off on the taxpayer and the surrounding property owners (that have zero to do with the incremental increase in traffic on the only road into and out of Woodlands Center.) But again, this is all just my opinion. We'll soon see how everything plays out in the real world.
