SUBJECT: Proposed Bill to amend Chapter 27 of the Hawai`i County Code 1983 (2005
Edition as Amended).
For your consideration, please find attached a bill to amend Chapter 27, article 2, section 27 -12,
and article 4, section 27 -17, section 27 -18, and section 27 -23 of the Hawai`i County Code 1983
(2005 Edition, as amended), relating to floodplain management.
This bill does the following:
• Eliminates the Buffer Zone
• Amends the definition of "Substantial improvement," changing the ten year recapture of
past improvements back to the prior Code's three year recapture
• Amends the prohibition against filling in a Zone VE to just structural fill
Please place on the appropriate committee agenda for the meetings on September 20, 2010.
