STATE OF HAWAI I COUNTY OF HAWAII - •�� " =: -.�� • � ` RESOLUTION NO. 401 10 RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A MEMORANDUM OF AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF HEALTH, HAWAII DISTRICT HEALTH OFFICE FOR THE PURCHASE AND TRANSFER OF THREE VEHICLES. WHEREAS, in pursuit of a mission to provide disaster response, the State of Hawai`i Department of Health, Hawai`i District Health Office (hereinafter "HDHO ") has requested funding from the Department of Homeland Security for the purchase of three (3) Ford F -250 pickup trucks be used as disaster response vehicles by the HDHO for its use and its agents use before, during and in the aftermath of a disaster or other public health emergency; and WHEREAS, the HDHO has stated it will use the vehicles in support of HDHO's multiple responsibilities for public health emergency and disaster preparedness and response; and WHEREAS, specifically, these trucks will provide critically needed capacity for the transport of emergency response supplies and equipment, and access to areas accessible only with four -wheel drive vehicles; and WHEREAS, HDHO's emergency and disaster responsibilities include, but are not limited to, the oversight of public sanitation including sewage disposal, drinking water systems, food safety, vector control following a disaster or disease outbreak such as dengue or West Nile virus, operation of Alternate Care Site shelters for individuals with special medical needs during disasters, operation of low- acuity care facilities to manage hospital patient over -flow during a pandemic and operation of mass dispensing sites in case of a bioterrorist event in the state; and WHEREAS, the County of Hawai`i Civil Defense Agency (hereinafter "CDA ") through the Hawai`i State Civil Defense (hereinafter "State Civil Defense ") as the pass through and administrative agencies for Homeland Security funding, will purchase the requested vehicles and transfer the same to the HDHO; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I, in accordance with Hawai`i Revised Statutes Section 46 -7, that the Mayor of the County of Hawai`i is authorized to execute, on behalf of the County of Hawai`i, the Memorandum of Agreement with the State of Hawai`i Department of Health, Hawai`i District Health Office, attached hereto and incorporated herein by reference as Exhibit "A" for the purchase and transfer of said vehicles. RECITALS: The Hawai'i County Civil Defense Agency (HCCDA) has the authority to purchase certain disaster response vehicles for donation to the Hawai'i District Health Office (HDHO) and its agents for use before, during, and in the aftermath of a disaster or other public health emergency. The parties hereto mutually desire to reach an understanding that will govern the use and management of three Ford F -250 pickup trucks to be purchased by Hawai'i County Civil Defense Agency for use in all- hazards emergency and disaster preparedness and response by the HDHO in and throughout Hawai'i County. Now, therefore, it is mutually agreed between the parties as follows: 1. Hawai'i County Civil Defense Agency agrees that it will purchase the above three pickup trucks, and that it will subsequently transfer ownership and legal title for said vehicles to the HDHO, which will use the vehicles in support of HDHO's multiple responsibilities for public health emergency and disaster preparedness and response. Specifically, these trucks will provide critically needed capacity for the transport of emergency response supplies and equipment, and access to areas accessible only with four - wheel -drive vehicles. HDHO's emergency and disaster responsibilities include, but are not limited to, oversight of public sanitation including sewage disposal; drinking water systems; food safety; vector control following a disaster or disease outbreak such as dengue or West Nile virus; operation of Alternate Care Site shelters for individuals with special medical needs during disasters; operation of low - acuity care facilities to manage hospital patient over -flow during a pandemic; and operation of mass dispensing sites in case of a bioterrorist event in the state. 2. The HDHO agrees that upon taking ownership of and receiving title to said vehicles it shall immediately assume responsibility for all costs associated with licensing, insuring, operating, and maintaining those vehicles; that it shall exercise reasonable care in the use of said vehicles during the conduct of its work; and that the vehicles shall be operated only by HDHO employees licensed under and pursuant to all applicable county and state vehicular laws and regulations. EXHIBIT "A" 3. The HDHO further recognizes that said vehicles are donated to it under Hawai'i County Civil Defense Agency's ongoing responsibilities to help develop and support county -wide, multi - agency capacity for all - hazards emergency and disaster preparedness and response. In witness, thereof, HCCDA has caused this agreement to be executed by its designated agent, Quince Mento, and the HDHO has caused this agreement to be executed by the Hawai'i State Department of Health's designated agent, Aaron Ueno, said agreement to become effective and operative upon the fixing of the last signature hereto.
