RESOLUTION NO. 406 10
RESOLUTION AUTHORIZING THE MAYOR AND THE DEPARTMENT OF PUBLIC
WORKS TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII
DEPARTMENT OF LAND AND NATURAL RESOURCES FOR PERMISSION TO
EFFECT IMPROVEMENTS TO THE RIGHT -OF -WAY FOR THE PORTION OF
OLD VOLCANO TRAIL BETWEEN THE INTERSECTIONS OF SOUTH KULANI
ROAD AND HAWAIIAN ACRES ROAD 1.
WHEREAS, a 400 -foot long portion of the roadway identified as the Old Volcano Road,
between the intersection of South Kulani Road and extending eastward to the intersection with
Hawaiian Acres Subdivisions' Road 1, directly adjacent along the north side of
TMK (3)1 -6- 013:080 and directly adjacent along the south side of TMK (3) 1 -7- 010:018
is under the jurisdiction of the State of Hawai`i Department of Land and Natural Resources; and
WHEREAS, this roadway is very narrow and has an irregularly paved surface; and
WHEREAS, although under the jurisdiction of the Department of Land and Natural
Resources, this agency has no mandate or intent to maintain this right -of -way; and
WHEREAS, the intersection of Old Volcano Trail and South Kulani Road carries a
heavy traffic load in and out of both Fern Acres and Hawaiian Acres Subdivisions; and
WHEREAS, traffic flowing out of Road 1 is sometimes blocked by incoming vehicles
on the Old Volcano Trail; and
WHEREAS, traffic flowing towards Road 1 from South Kulani Road has a limited view
and cannot see vehicles on the far end of the narrow stretch until after turning off South Kulani
Road; and
WHEREAS, these conditions often lead to situations where multiple vehicles must
reverse or completely leave the roadway to allow passage; and
WHEREAS, this segment of Old Volcano Trail is one of only two access routes to
State Highway 11 servicing the very large settlement area of Hawaiian Acres; and
WHEREAS, the narrowness of this segment of Old Volcano Trail is the primary cause
of traffic gridlock at South Kulani Road; and
WHEREAS, the lack of any alternate routes elevates this gridlock situation to an urgent
matter of public safety for both the Hawaiian Acres and Fern Acres subdivisions; and
WHEREAS, the Department of Public Works has acknowledged the increase in traffic
loads, largely due to increased population in this area, and has recently paved and improved the
County portion of South Kulani Road; and
WHEREAS, the Department of Land and Natural Resources has initiated research for
issuance of a permit for the Department of Public Works to effect improvements to widen and
resurface this portion of Old Volcano Trail; and
WHEREAS, pursuant to Hawai`i Revised Statues, section 46 -7, the Council may consent
to agreements between the County and the State government respecting action to be taken
pursuant to the powers granted to the County by law and to furnish, expend, and receive any
funds or other assistance in connection with projects to be undertaken by the County; now,
therefore:
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in
accordance with section 46 -7, Hawai`i Revised Statutes, the Mayor of the County of Hawaii is
hereby authorized to enter into and execute on behalf of the County a memorandum of
agreement with the State of Hawai`i for execution of Old Volcano Trail improvements.

BE IT FURTHER RESOLVED that the Department of Public Works shall with all due
diligence pursue this agreement so as to expediently address the safety and congestion issues
existent on the segment of Old Volcano Trail, between the intersection of South Kulani Road
and extending eastward to the intersection with Hawaiian Acres Road 1.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to: (1) the Honorable Mayor William P. Kenoi; (2) the Director of the Department of
Public Works, Warren H.W. Lee; and (3) the Department of Land and Natural Resources,
Hawai`i District Land Agent, Kevin Moore.
