COUNTY OF HAWAII - •_`''/ •1- STATE OF HAWAII j Ni M RESOLUTION NO. 402 10 RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOTS A, B, F AND H, OF THE HUALALAI HEIGHTS SUBDIVISION, BEING PORTIONS OF TAX MAP KEY: (3)7 -5- 043:029, SITUATE AT PUAPUAANUI 1ST, DISTRICT OF NORTH KONA, COUNTY AND STATE OF HAWAII, FROM INTERNATIONAL DEVELOPMENT PROJECTS, LTD. AND PUALANI ESTATES, INC. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. WHEREAS, International Development Projects, Ltd. and Pualani Estates, Inc. are the owners of: Lot A Puapuaanui Street (por.) 75,441 sq. ft. Lot B Pualena Street 13,078 sq. ft. Lot F Hualalai Road 14,414 sq. ft. Lot H Pualena Street 29,117 sq. ft. identified as being portions of Tax Map Key: (3) 7 -5- 043:029, situate at Puapuaanui 1st, in the District of North Kona, County and State of Hawai`i, as delineated on Exhibit "A" attached; and WHEREAS, the dedication of these roadway lots is required by Condition F of change of zone Ordinance No. 95 -100; and WHEREAS, International Development Projects, Ltd. and Pualani Estates, Inc. have constructed all subdivision improvements and received final subdivision approval; and WHEREAS, International Development Projects, Ltd. and Pualani Estates, Inc. are desirous of dedicating the above roadway lots, including all subdivision improvements thereon, to the County of Hawai`i for road and drainage purposes, and the improvements have been inspected and approved by the County of Hawai`i Department of Public Works, and received dedication approval from the Department of Water Supply, Planning Department and Department of Environmental Management; and WHEREAS, the subject roads and drainage improvements have been completed according to County of Hawai`i standards, and are in acceptable condition for dedication, and in full compliance with the provisions of Chapter 23 of the Hawai`i County Code; and WHEREAS, Section 23 -10 of the Hawai`i County Code prohibits the Council from receiving by dedication any streets in any subdivision platted after December 2, 1966 except upon full compliance with the provisions of Chapter 23; and WHEREAS, Article XIII, Section 13 -12 of the Hawai`i County Charter, provides that the council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds the subject subdivision and improvements thereon are in full compliance with the provisions of Chapter 23 of the Hawaii County Code as certified and approved by all applicable agencies. BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13 -12 of the Hawaii County Charter, and Section 23 -10 of the Hawai`i County Code, that the County of Hawai`i accepts the dedication of: Lot A Puapuaanui Street (por.) 75,441 sq. ft. Lot B Pualena Street 13,078 sq. ft. Lot F Hualalai Road 14,414 sq. ft. Lot H Pualena Street 29,117 sq. ft. identified as being a portion of Tax Map Key: (3)7 -5- 043 -029, delineated on Exhibit "A" attached hereto, including all improvements thereon, for public road and drainage purposes. 2 BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Mayor William P. Kenoi; (2) the Department of Public Works; (3) Deputy Corporation Counsel Gerald Takase; and (4) Steven S.C. Lim, Esq., Carlsmith Ball, 121 Waianuenue Avenue, Hilo, Hawai`i 96720.
