Re: Proposed Amendment to Bill 300, Draft 2, Which Amends Section 25-8-4, Article 8,
Chapter 25 (Zoning Code) of the Hawaii County Code 1983 (2005 Edition), By
Changing the District Classification from Single - Family Residential — 15,000 Square
Feet (RS -15) to Neighborhood Commercial — 20,000 Square Feet (CN -20) at Haleki`i
and Kanaueue, South Kona, Hawaii Covered by TMK 8 -1 -025: Ol 1
Please find below a proposed amendment to Bill 300, Draft 2. The proposed amendment is indicated
by Ramseyer format with respect to Bill 300, Draft 2, and bolded for illustrative purposes. The
amendment removes the comma after the word "Street" in the third line of the first sentence of
Condition G, and read as follows:
"G. A traffic signal at the intersection of Mamalahoa Highway and Haukapila Street with
appropriate synchronization with the traffic signal lights at the intersection of
Mamalahoa Highway and Haleki`i Street [ and improvements to the
Mamalahoa/Haukapila intersection as recommended by the Department of Public
Works shall be installed. The traffic signal light and intersection improvements shall be
completed prior to the issuance of a Certificate of Occupancy for the proposed project,
provided that in no event shall a Certificate of Occupancy for any portion of the project
be issued within three years from the effective date of this ordinance. Furthermore, the
applicant shall cooperate with appropriate governmental agencies and, if deemed
necessary by said agencies, contribute its pro rata share of improvements to Haukapila
Street, if required."
