Your Committee on Finance, to which was referred Bill No. 206, reports as follows:
Bill No. 206, transmitted by Mayor Stephen K. Yamashiro, via Communication No. 661, dated
February 7, 2000, amends Chapter 24, Division 6, Section 24-242, Hawaii County Code, as
amended, by repealing parking permit fees for disabled persons.
Bill No. 206 proposes to remove the requirement that fees be paid for both the temporary and the
permanent placards. This measure will bring the County of Hawaii in line with the Ninth
Circuit Court's decision in the case of Emerick v. City and County of Hawai `i, No. 98-16427 (9`~
Cir., 1999). In that case, the United States Court of Appeals overturned the District Court's
decision that the City and County of Honolulu could charge fee for handicapped parking permits
as long as the fee was not more than the actual administrative costs for the permits.
Your Committee on Finance is in accord with the purpose and intent to Bill No. 206 and
recommends it pass first reading.
