RESOLUTION NO. 407 10
RESOLUTION AUTHORIZING THE TEMPORARY CLOSURE OF THE STUB -OUT
AT THE END OF ALOHALANI DRIVE WHERE IT INTERSECTS WITH KAUNALOA
STREET, IN THE DISTRICT OF SOUTH HILO, COUNTY AND STATE OF HAWAII.
WHEREAS, the Hawaii County Code, Chapter 24, Article 7, Division 3, Section 24-
153.3, Subsection (b) provides:
"(b) The council by resolution, in consultation with the chief of police and the
director of public works, may authorize the temporary closure of a roadway
stub -out, dead -end and /or other road terminus when the following conditions
exists:
1) The stub -out, dead -end or similar road terminus to be barricaded is
owned by the county.
2) The closure shall not affect the flow of traffic or public access.
3) Adjacent landowners are provided with written notification by the
requesting agency.
4) The closure is necessary to prevent loitering, littering and other illegal
activities.
Removal of the temporary closure shall be authorized by council resolution."
; and
WHEREAS, the County of Hawaii owns Alohalani Drive, which extends from Haihai
Street in the district of South Hilo, County and State of Hawaii (see attached Exhibit A); and
WHEREAS, the Department of Public Works finds that closure of this stub -out will not
affect the flow of traffic or public access; and
WHEREAS, letters were sent to residents near the intersection of Alohalani Drive and
Kaunaloa Street requesting their feedback regarding the closure of the stub -out, and of those that
responded (14 responses), 86% (12) were in support of the closure and 14% (two) were opposed;
and
WHEREAS, residents in the area have complained that the stub -out at the end of
Alohalani Drive (as indicated by the arrow on the attached Exhibit A) provides a convenient and
unrestricted area for activities that compromise public safety, including loitering, littering,
consumption of alcohol, and other illegal activities; and
WHEREAS, in order to curtail acts of loitering, littering, and illegal consumption of
alcohol, and to promote a safer and cleaner community that can be fully enjoyed and embraced
by its residents, the council finds that the stub -out at the end of Alohalani Street should be
temporarily closed; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that
pursuant to Section 24- 153.3, Subsection (b) of the Hawai`i County Code, the stub -out at the end
of Alohalani Drive as shown in Exhibit A, attached hereto, shall be closed until such time as the
council, by resolution, authorizes its reopening.
BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this
resolution to the Honorable Mayor William P. Kenoi, the Director of the Department of Public
Works, and the Chief of the Hawai`i Police Department.
