COUNTY OF HAWAII STATE OF HAWAII
RESOLUTION
WHEREAS, Chapter 6, Article 1, Section 6 -6 of the Hawaii County Code 1983, authorizes the
chief engineer of the County to collect a fee of $35 00 for each cemetery plot at the Alae Cemetery,
exclusive of the cost of digging and covering the plot, and
WHEREAS, according to the rules relating to user fees, dated July 8, 1985, of the Department of
Parks and Recreation, the director has been collecting a fee of $100 00 for these very same plots, and
WHEREAS, the Hawaii County Code cannot be superseded by a department administrative rule
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that the Legislative Auditor conduct an investigation to see how long this practice has taken place and
under what authority the Department of Parks and Recreation began collecting $100 00 per cemetery plot,
contrary to the Hawaii County Code
BE IT FURTHER RESOLVED that if it is found that any person was overcharged for the plots at
Alae Cemetery, the County will reimburse the person, his/her estate or heirs, which ever is appropriate, for
the overpayment
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmit copies of this
resolution to the Honorable Stephen K Yamashiro, Mayor, County of Hawaii, Mr George Yoshida,
Director, Department of Parks and Recreation, Ms Donna Kiyosaki, Chief Engineer, Department of Public
Works, Mr Harry Takahashi, Director, Department of Finance, and Mr Richard Wurdeman, Corporation
