Box 109 Kealakekua, HI 96750 Fax: 323 -2304 Ken's Cell: 345 -0854 E -Mail: October 19, 2010 Councilman Guy Enriques, Chair Chairman of the Public Works Committee Hawaii County Council 25 Aupuni Street, Hilo 96720 Subject: Proposed Amendments to Ch 27 Dear Mr. Chairman and Members of the Council, I request your support for the requested revisions to Chapter 27 to delete the buffer zone and to return to the 3 year investment cycle for affected properties. In my business, I assist local landowners to implement their projects. Since 2006, 1 know of 3 appropriately zoned properties that have not been able to be developed because of the new buffer. The Kona CDP seeks to concentrate future growth for mauka Kona within existing communities and along Mamalahoa Hwy. All 3 of the properties I reference have existing commercial zoning and 2 have existing commercial uses to which renovation is desired. The owners of the former Kona Meat Market have submitted testimony and l bring testimony for the Owner next to Ushijima Store in Honalo to you today. The third is the Little Grass Shack in Kealakekua, on TMK 8 -1- 04:45, where renovations become prohibited by the 50' buffer, where flood waters from Konawaena School upslope has never affected, and a 10 year investment cycle won't allow sufficient renovation to restore the old buildings. Please amend Chapter 27 to remove these punitive provisions. It should allow some of our local families more opportunities to build productive uses within the existing urban areas.
