Proposed Sale of Portion of Kama'oa Rd.
Dear Council Chair Yoshimoto and Members of the County Council:
The discussion on the proposed sale of a portion of Kama'oa Rd. has assumed that
the legal right -of -way dead -ends about 7000' west of its intersection with the
South Point Rd., as shown on the current tax maps, at the east boundary of T.M.K.
No. 9- 3- 005 -001. This is the segment that is being considered for sale in
Resolution 377 -10. Actually, this is just a portion of a road that went from Ka'u to
Kona in the mid- 1800's, and the legal right -of -way may still exist connecting
Kamaoa Rd. from the South Point Rd. to the current Hawai'i Belt Highway,
extending northwest across about 1.7 miles of countryside beyond the point where
the current tax maps show it ending. The physical road no longer exists in most of
this area, but the legal right -of -way may still belong to the public.
I've enclosed a copy of State Registered Map No. 1677. This map was completed
in 1894 from surveys made in 1887 -1890. I've enclosed both a greatly reduced
copy of the full map (which is about 3' by 4'), and an enlarged section of the area
in question. The full map clearly shows what we now call Kama'oa Rd. as the
Ka'u to Kona road. On the enlarged map showing the area in question, I've
labeled "end point per current tax map." Reg. Map. 1677 shows the road
continuing to the northwest from this point, and on toward Kona.
To give an idea of the location of this road with respect to current landmarks, I've
drawn its approximate location as a dashed line on a USGS quad map, labeled
"Map 2 ". This sketch shows that the road ran east of the three large pit craters in
the area, and it intersects the current Hawai'i Belt Highway near the intersection of

the Old Mamalahoa Highway (which is a continuation of this road) and near the
intersection of the current Kahuku Ranch road.
This road is also mentioned as a boundary of at least two of the grants in the area,
Grant 2649 and Grant 2787. I've enclosed copies of both of these grants. It is
"alanui aupuni" in Gr. 2649 and "Aupuni Rd." in Gr. 2787. Thus, this road was in
existence in 1859, the date of Gr. 2649.
At some point, this road was replaced as the Ka'u to Kona route by a more mauka
road, and the segment beyond where the current tax maps show it ending became
disused, or possibly was destroyed by lava. I don't know the history or dates.
Is there still a public right -of -way over the 1.7 miles or so between where the road
seems to end on the current tax maps, and its intersection with Hawai'i Belt
Highway? My research cannot exclude the possibility that this has been
extinguished by some prior governmental surrender of the right -of -way. But
unless something like that has happened, the part of Kamaoa Rd. being considered
for sale is just a portion of a right -of -way that connects South Point Rd. to the
Hawai'i Belt Highway, and potentially provides access to a large area where the
public cannot otherwise go.
I'm not writing this letter to advocate for or against the sale of the segment of the
road described in this resolution. I'm sure there are factors that I don't know
about, and there are certainly circumstances where the public interest is done no
harm by the sale of an old unused road. It's just that the decision should be made
based on full information, and I hope that the Council finds this letter useful.
