ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 4, OF THE HAWAII COUNTY
CODE 1983 (2005 EDITION, AS AMENDED), BY ADDING A NEW SECTION
RELATING TO CHANGE ORDERS AND CONTRACT SUPPLEMENTS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. In accordance with Section 103D -501 of the Hawai`i Revised
Statutes and Chapter 3 -125 of the Hawai`i Administrative Rules, the administration of the County
may at any time during the fiscal year: 1) execute change orders relating to changes in work
scope, specifications, price or time in a construction contract such as a contract for constructing,
altering, repairing or improving new or existing buildings, structure, roadways, floodways, and
other facilities or infrastructure; or 2) execute contract supplements relating to changes in work
scope, specification, price or time in a professional service contract such as a contract for
architecture and engineering, survey and mapping, environmental or traffic studies, and project
management or inspection. The purpose of this ordinance is to 1) provide a process that allows
public review in matters relating to change orders and contract supplements and 2) provide
essential information that can help develop internal action plans to ensure efficient and
productive allocations of County resources.
SECTION 2. Chapter 2, article 4, of the Hawai`i County Code 1983 (2005 Edition, as
amended), is amended by adding a new section to be appropriately designated and to read as
follows:
"Section 2- . Change orders and contract supplements; notification to the
council.
The director of finance shall notify the council of all change orders and
contract supplements executed by the County no later than thirty days after
authorization of the change order or contract supplement. Notification shall be
provided by submitting a report to be placed on the council committee agenda
designated to handle matters of finance. The report shall include the following:
job number; contract number; project title; contract type; contracting agency,
office, or department of the County; project manager; contractor or contractors;
original contract amount; date the contract was awarded; number of change orders
or contract supplements; total amount of the change order or contract supplement;
percentage of increase or decrease; and the status of the project."
SECTION 3. New material is underscored. In printing this ordinance, the
underscoring need not be included.
SECTION 4. If any provision of this ordinance, or the application thereof to any
person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance, which can be given effect without the invalid provision or
application, and to this end, the provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
