Re: Resolution for multi -year subscription agreement
Enclosed is a resolution authorizing the payment of funds for more than one fiscal year
for a new multi -year subscription agreement with Thomson West for Westlaw Next
online legal research service.
The current subscriber agreement expires on December 31, 2010 and the Office of the
Prosecuting Attorney wishes to extend this. They have been offered a multi -year
subscription rate, which represents a significant annual cost savings over one -year
agreement terms. This service, which they have been using for over 15 years, has
been utilized to reduce their book subscriptions and the costs of legal research.
Because of the impending expiration of their current subscriber agreement at the end of
December, and due to the cancellation of the December 14 Committee meeting, the
Office of the Prosecuting Attorney requests that the resolution be waived from the
Finance Committee and heard at the December 15, 2010 Council meeting. In the event
that such a waiver is not granted, the alternative one -year contract agreement will be
implemented and we ask that this resolution request be withdrawn.

A. REQUEST:
Approval to enter into a multi -year agreement with Thompson West for online legal research service.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The Office seeks to renew our agreement with Thomson West for Westlaw Next online legal research. Our
current subscriber agreement expires on December 31, 2010. We have been offered a rate of $2,862 per
month if we commit to a two or three year agreement. This represents a savings of $53 /month over the one -
year agreement cost of $2,915 /month.
We have been utilizing Westlaw for legal research for over 15 years. The plan offers unlimited access to 35
attorneys and other appropriate support staff. It should be noted that the monthly rate is a tremendous
savings over paying for research at the customary hourly rate and that we have been able to reduce our
book subscriptions in lieu of providing our legal staff online research capabilities.
We request waiver of Finance Committee action in order to complete the approval process prior to our
agreement expiration date.

RE: Resolution No. 14 - 10 : Resolution authorizing the payment of funds for
more than one fiscal year for a new multi -year subscription agreement with
Thomson West for Westlaw Next online legal research service
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above - referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
