Aloha County Council Members:
Thank you for this opportunity to file into the Hawaii County Clerks repository
of records more documented information and evidence of your knowing and
knowingly violations of the Securities Act of 1933, Section 17(a)(2). and United States
Criminal Code 18 U.S.C. 1344 Bank Fraud, along with additional evidence and
documentation to support the exposure of a racketeering enterprise composed of
corrupt government officials engaged in patterns and histories of racketeering
activities in violation of the Federal RICO Act.

Due to your approval of a $56M Bond offer you have confessed to violations of
the Section 17(a)(2) of the Securities Act of 1933 which now places the County of
Hawaii under the authority of the Securities & Exchange Commission Regulations for
risk assessment disclosure related to the issuance of Municipal General Obligation
Bonds. The attached Front Page, Friday March 12, 2010 Hawaii Tribune - Herald
article titled, "Mauka development raises flood dangers ", the Front Page Monday,
November 15, 2010 Hawaii Tribune - Herald article, "Vote to hike county debt set ", the
FEMA news release, "Alenaio Flood Control Project, Flood Control Keeps Community
Dry, and the 2004 FEMA Flood Insurance Study, Hawaii County, Hawaii Volume 1 of
4, cover page and pages 10, 11, identify and document a risk and liability to Bond
Investors that must be disclosed along with the $56M Bond Offer. The County of
Hawaii has had 10 major flooding events from 1920 to 1994, and major flooding
events causing tens of millions of dollars in property damage in 2000 and 2008.
The County Council's actions on year 2010 Bills 298, 301, and 311 identify a
pattern and history organized government corruption in the County, State, and
Federal offices in Hawaii that is well documented and uncontested in State and
Federal Court Records. The County of Hawaii in 2001 authorized and supervised the
illegal alteration of stream beds in areas of Hilo, Hawaii with over 4,000 cubic yards
of material to provide flood protection to private property for land /property
development in areas that should have been in FEMA Flood Zone "A" restricting any
construction or development, in addition the Hawaii County Council authorized the
approval and production of corrupt and /or fraudlent FEMAS FIRM's, Flood Insurance
Rate Maps, for the waiakea areas of Hilo, Hawaii that profited, or will profit politically
privileged people at the expense and extensive flood damage to properties
downstream of the illegal stream diversion works structures. Hawaii County Mayor
Billy Kenoi's statements in the 12 March 2010 Tribune - Herald article, along with the
statements of Dereck Chow, Chief of civil works for the U.S. Army Corps of
Engineers, and Hawaii County Public Works Director Warren Lee is a direct
confession that the County of Hawaii and the Federal Government have specific
knowledge of an imminent peril to the Public Safety, Health, and Welfare of the
residents of Hawaii County that will require 20 -50 million dollars to fund and the
design and requires the approval of congress which would require testimony before
Congress and would also expose organized corruption in the County, State, and
Federal offices in Hawaii.
The approval of the Hawaii County Council to float a $56M bond offer /loan that
has no legal requirements as to its use and will not be used as inferred by the mayor
for Community projects but will be used for emergency funding of the Flood Control
Projects to provide Flood Control Protection of the concentration people along with a
high concentration of county officials and employees that adhere to "Local" cultural
and ethnic norms and are under the influence and control of corrupt government
officials and politically privileged people's who have property in the Waiakea areas
which will result in the exposure of, and the membership of, and Enterprise of
corrupt County State, and Federal officials organized and. controlled by and through
"Local" cultural and ethnic norms that influence, control, or extort County, state, and
federal officials and employees within the state of Hawaii, and Judges and Officers of
the State and Federal Court systems in Hawaii, with the apparent membership of the
RICO Enterprise to include, but not limited to, State Attorney General Mark Bennett,
State Health Director Chiyome Fukino M.D., Former U.S. Attorney for Hawaii Edward
Kubo, current U.S. Attorney for Hawaii Florence Nakakuni, U.S. Senator Daniel
Inouye, and other officials identified and the court records RE: Cole v County of
Hawaii Civil No. 10 -1 -0082 in the 3rd Circuit Court, State of Hawaii, and RE: Cole v
County and State of Hawaii Civil No. 05 -00325 JMS -BMK, U.S. District Court,
District of Hawaii.

OK $56M Loan", it is highly recommended you contact the Banking Firms that will be
handling the $56M Bonds or Loan and ask them to have "their", Legal Counsel review
my testimony and documentations I have presented before the Council. I believe you
will find that your Hawaii County Corporate Counsel Lincoln S.T. Ashida does not
understand the civil and criminal aspects of Securities & Exchange Commission
violations, and he cannot use the "Local Boy" influence he has with the Hawaii
County Police Department, County Officials, Judges, and Officers of the 3rd. Circuit
State Court with the Lawyers and Federal Courts you will be facing. Google 18 USC
1344 and see for your self what you are facing, and remember Lincoln S.T. Ashida is
just advising you, like a CPA would advise you on your Tax filings, it is your vote and
your signature on the approval to issue $56M of Municipal General Obligation Bonds
that are NOT legally directed towards any specific projects without full disclosure of
the County's actions RE: Dan A. Cole. You, Council members, will be going to
Federal Prison and /or pay up to a million dollars in personal fines if convicted„ not
Corporate Counsel Ashida.
Please remember that when the Flood Event I have described before you in
Testimony, and is on file in State and Federal Court records, occurs it will be an
Overt Occurrence and all civil and criminal tolling statutes will be begin anew.
The documented and verifiable facts that Lincoln S.T.Ashida has used his official
County Position and County Letterhead in multiple acts of extortion against my
person to influence the Hawaii County Police Department not to except any of the
four, (4), complaints attempted to be filed that would expose organized government
corruption and violations of Hawaii Revised statutes for Extortion from a person
under the United States, influence the Hawaii County Prosecutors Office not to
pursue any actions against corrupt government officials, influence the Hawaii
County Council through extortionate actions and methods deny a person the
representation from their elected officials, and influence, through secret extortionate
actions, the Hawaii County Board of ethics to dismiss a complaint against himself,
Lincoln S.T.Ashida, County Council member Naeole, et. al., as part of a conspiracy
against civil rights under the color of law for the purpose to defraud the County and
Federal governments with the approval of corrupt and fraudulent FEMA FIRM's that
benefit members of a "Local" RICO Enterprise in land /property development, is more
than sufficient to cause a review of the County's Bond rating for the required Risk

Alenaio Flood Control Project
Flood Control Keeps Community Dry ,.
Hilo, HI - It was November 2000 when more than 27 inches of rain fell on the city of Ham ,
Hilo in a 24 -hour period. The banks of the Alenaio Stream overflowed, and the water
marks reached 10 feet high. Fortunately for the community of Hilo, the floodwall was 12 Hari
feet high.
FLOOMNO
Between 1920 and 1994, the 10 reported major flooding events in the city often took
with it lives and devastated residential and commercial structures. The Alenaio Stream
had flowed through residential areas to the business district of Hilo, a principal urban
center and the county seat for the County of Hawaii.
It was in 1994 when the Water Resources Development Act of 1990 authorized the
Secretary of the Army to construct a watershed to control and direct floodwaters. This
project was designed to contain the 100 -year flood, removing the flood designation for M ilir
eight properties. One of these is the Hilo Central Fie Station, which was then eligible
for a Hazard Mitigation (404) Grant to seismically retrofit the Drying Tower. The
floodwall guides the water into the channel and terminates in a catch basin, which also
serves as a soccer field. The soccer field was constructed in an area where commercial
structures had previously been flooded and destroyed by Tsunamis. The excess water Pic
from the channel captured in the soccer field ultimately flows to the Pacific Ocean. Cost
$14,200,000.00 (Actual)
As expected, the water from the record- breaking rains of November 2000 flowed Pte, Activity/Project
successfully through the channel and into the soccer field. This rainstorm was the first Flood control
real test of the flood control project. More than 27 inches of rain fell on Hilo in a 24-
Primary hour period. ��
Hated Mitigadon Grant Program (HMGP)
The uprooted trees, large boulders and twisted bleachers where businesses once
resided, were visual reminders of what could have happened had the project not been
accomplished.
The US Army Corps of Engineers estimated that the project helped the community
avoid in excess of $20miHion in damages. The watershed more than paid for itself in
this single event.

Islands, Japan, Kamchatka, the islands lying between the Philippines
and Samoa, and even Hawaii itself. The City of Hilo has been most
severely damaged. Based on 1970 figures, Hilo had suffered losses of
$62 million over the past 50 years.
While the specific cause of tsunamis can be attributed solely to the
faulting of the ocean floor, the cause of flooding as a result of
stream overflow is not limited to a single factor. Possible flood
causes include: debris- clogged streams, flash floods, undefined
streamflow patterns, isolated depressions in topography, inadequate
drainage facilities, and changed drainage conditions because of
development.
Rainfall related flood problems in the detailed and approximate study
areas are further discussed by flooding source in the following
paragraphs.
NORTH KOHALA AREA
Most of the 15 gulches within the district are heavily vegetated and
well - defined at the lower reaches below Mahukona- Niulii Road. Above
Mahukona - Niulii Road, the gulches are less defined and less densely
vegetated. No major flood problems have been identified, and only
minimal damage by sheet runoff has been reported in the Hawi and
Kapaau areas.
SOUTH KOHALA AREA
For the approximate study areas of Gulch 1 and Makeahua and Makahuna
Gulches, no major flood conditions are identified. Coastal areas of
the South Kohala District from Kawaihae to Puako are subject to
shallow flooding. Specifically, Gulch 2- Hapuna, Gulch 3- Hapuna, Gulch
4- Puako, Kamakoa Gulch, and Auwaiakeakua Gulch usually contain the
runoff in the higher segments, but become undefined in the lower
regions, causing shallow flooding conditions.
In the Waimea region, rock outcrops and sharp bends of Waikoloa Stream
form restrictive sections that enhance flooding. This condition is
most evident in the area immediately downstream of the Lindsey Street
bridge. Here, the floodwaters of Waikoloa Stream tend to back up and
overflow because of exaggerated, acute channel bends and thick foliage
immediately downstream of the bridge. During flood stages, water
overtops the bridge and floods the vicinity. Further downstream,
however, the entire flow is maintained within the Waikoloa Stream
floodplain.
In the past, overflow of Lanimaumau Stream has caused severe economic
damage. The storm of August 1958,,. for example, resulted in damage to
truck -farm crops from floodwater as deep as 2.5 feet. Total estimated
damage was $186,380. Recently, this flood damage potential has been
reduced by the construction of the Puukapu Channel (Reference 1).
SOUTH HILO AREA
Alenaio Stream flows indicate a floodprone situation. On
July 25, 1966, the overflow points were the Kapiolani Street bridge,
the Ululani Street bridge, the Kinoole Street bridge, the Kilauea

Street bridge, and Waialama Canal. The diversion dam above Kinoole
Street (Ponahawi box drain) clogged, and the ensuing full flow along
the stream resulted in the complete collapse of homes in the vicinity
'; of Osorio Lane. The
( precipitation from the July 25 storm has been
estimated as having a 50 -year recurrence interval. Flow impediments
increased the magnitude of flooding caused by the event. Conditions
that abet flooding in the area are the blockage of the streambed with
I existing pipe crossings and the heavy growth of grass on the streambed
and banks.
During the period
February 18 -25 1979, intense rainfall resulted in
extensive flooding, especially in the low lying areas of Hilo. More
than 100 homes along the Palai /Four -Mile Creek drainageway were
• inundated, forcing a general evacuation of the area. Stream overflow
onto Kanoelehua Avenue caused disruption of traffic.
The aforementioned storm events represent a mere sample of the extreme
nature of flooding experienced in the area. Principal flood problems
I within the study limits include stream overflow along drainageways and
surface runoff resulting from inadequate interior drainage.
KAU AREA
The Kau district has been subjected to severe floods in Naalehu,
Waiohinu, and Pahala, but improvements in these locations have
lessened flood hazards. Overall, the flood threat has been reduced in
the desert region of the island, especially at Ninole Gulch, where
protective earthen dikes were built to minimize flooding.
HAMAKUA AREA
The Town of Honokaa, located in the northern Hamakua region, is
subject to sheetflow flood problems, as a result of the lack of
well - developed stream channels in the area.
Notable floods in the area include those of April 1961 and
November 1979. The rare flood of April 2 -3, 1979, was one of flash
nature, combining the elements of intense rainfall and steeply sloped
mountains to produce rapidly concentrating runoff. Damages to sugar,
farming, and cattle ranching industries were reported. During this
storm, nearly all culverts were overtopped, including those that
crossed the interstate defense highway. Those culverts were designed
to handle 50 -year discharges, according to Hawaii State standards. At
several locations, channel cross sections upstream of culverts
contained areas twice as large or larger than the size of the culvert.
Some county bridges were overtopped as well.
Thunderstorm rain over Mauna Kea and the Kohala Mountains during the
November 16 -19, 1979, storm caused severe damage to the east Hawaii
area, including the Town of Honokaa. Sugarcane and diversified
agriculture in the area suffered the heaviest loss. Roads, bridges,
water supply pipes, and other public works were damaged by floodwater
as well. As an indication of the flood magnitude, the neighboring
Ahualoa Stream was recorded at 4,100 cubic feet per second (cfs) on
November 17 -18, 1979. This station has been in operation since 1963
and the previous known maximum flow was 760 cfs on January 14, 1979.
