Ford, Council Member SUBJECT: Proposed Amendments to Resolution 16 -11; To Authorize the Acceptance of a Monetary Donation of $1,600 for the Purchase of Tactical Bike Patrol Equipment for the Hawai`i County Police Department For your consideration, please find attached proposed amendments to Resolution No. 16 -11. The proposed amendments, illustrated via Ramseyer format with respect to the contents of Resolution No. 16 -11, read as follows: 1. The third WHEREAS clause is amended to read: "WHEREAS, Article XIII, Section 13 -12, of the Hawai'i County Charter provides that the Council, on behalf of the County, may accept gifts or donations of personal property, and Chapter 2, Article 30, Section 2 -162 (a) of the Hawaii County Code states that any gifts or donations of money, securities, or personal property which fall within the capitalization procedures of the department of finance may be accepted by resolution approved by the council; and" 2. The fourth WHEREAS clause is amended to read: "WHEREAS, the Hawaii County Police Department recommends the acceptance of this donation[:]; now, therefore," 3. The enacting clause is amended to read: "[ ,] BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in accordance with Article XIII, Section 13 -12, of the Hawai`i County Charter, and Chapter 2, Article 30, Section 2 -162 (a) of the Hawaii County Code, the Council of the County of Hawai'i accepts this donation." ,, Comm. Date JANE 0 3 2011 RESOLUTION AUTHORIZING THE ACCEPTANCE OF A MONETARY DONATION OF $1,600 FOR THE PURCHASE OF TACTICAL BIKE PATROL EQUIPMENT FOR THE HAWAII COUNTY POLICE DEPARTMENT WHEREAS, Target is donating $1,600 to the Kona Community Policing Section of the Hawai'i County Police Department for the purchase of tactical bike patrol equipment; and WHEREAS, this grant will allow the police officers of the Kona Community Policing Section to expand their bike patrol unit by providing necessary equipment; and WHEREAS, Article XIII, Section 13 -12, of the Hawai'i County Charter provides that the Council, on behalf of the County, may accept gifts or donations of personal property, and Chapter 2, Article 30, Section 2 -162 (a) of the Hawaii County Code states that any gifts or donations of money, securities, or personal property which fall within the capitalization procedures of the department of finance may be accepted by resolution approved by the council; and WHEREAS, the Hawaii County Police Department recommends the acceptance of this donation; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in accordance with Article XIII, Section 13 -12, of the Hawaii County Charter, and Chapter 2, Article 30, Section 2 -162 (a) of the Hawaii County Code, the Council of the County of Hawai'i accepts this donation. BE IT FINALLY RESOLVED that a letter of appreciation and a copy of this resolution be sent to Target, 74 -5455 Makala Blvd., Kailua -Kona, Hawai'i, 96740, acknowledging this generous donation. Dated at , Hawai'i, this day of , 2011. 4. The final clause is amended to read: "BE IT [FURTHER] FINALLY RESOLVED that a letter of appreciation and a copy of this resolution be sent to Target, 74 -5455 Makala Blvd., Kailua -Kona, Hawai'i, 96740, acknowledging this generous donation." 5.
