No. 377 -10 PLACE: Sheraton Keauhou Bay Resort & Spa (2008 -2010 ) 78 -128 `Ehukai Street Kailua -Kona, Hawaii TIME: 11:26 a.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Finance, to which was referred Resolution No. 377 -10, Communication No. 901, reports as follows: Resolution No. 377 -10, transmitted by Council Member Guy Enriques via Communication No. 901, dated July 22, 2010, to authorize the abandonment and sale of a remnant of Old Homestead Road, also known as Kama`oa Road, in the district of Ka`u. This matter was held over on August 17, 2010 for a site visit and public hearing which was held in Na`alehu on November 9, 2010. Comments and concerns from Your Committee Members: 1) County should not sell public roads, especially those with historical significance and public use as indicated in Communication 901,20 dated November 6, 2011 from Mr. Chris Yuen, 2) inappropriate gating in the past of this road affected public access, 3) sale of homestead roads will set a precedence on sale of remnants and impact public access in other communities, 4) it was expressed by some community members that the old Hawaiian trail exist next to stonewall and not on road, use will be minimal by public and if County will pay for maintenance if there is no support on sale of remnant, 5) adjoining owners and ranchers are impacted by illegal hunting, poaching and trespassers, 6) previous Council created a division in community into three groups; adjoining owners, outside community members against sale and Native Hawaiians due to site visit and public hearing, 7) retaining public domain such as this remnant is important for the future. Planning Director Bobby Jean Leithead Todd appeared before Your Committee. Ms. Leithead Todd's change of recommendation on supporting the remnant sale of the road was based on the following: 1) the road did not provide public access to State owned mauka parcels or shoreline areas; 2) DPW no longer needs it in their road inventory; 3) she apprised adjoining owners that any future development on their parcels it will be at their expense to improve remnant road to county dedicable standards. She also added that a cattle -guard should be installed at the entrance of Kama`oa Road to contain cattle from exiting on to highway. For informational purposes, Mr. Yoshimoto voted " kanalua" twice.
