Your Committee on Finance, to which was referred Resolution No. 234-00, reports as follows:
Resolution No. 234-00, transmitted by Finance Director Harry Takahashi, via Communication
No. 715, dated March 21, 2000, authorizes the sale by negotiation of three cottages at Kohala
High and Elementary School to Catherine Morgan.
The County Council adopted Resolution 197-94 on May 11, 1994, to dispose of the cottages
through public auctioning. However, the Department of Finance was unable to attract any
bidders.
Catherine Morgan is offering to purchase the three cottages for $25.00 and assume all costs
involved in the removal of the buildings.
Pursuant to Section 2-11 1, Hawaii County Code, the council may, by resolution, as approved by a
majority of its members, direct the finance director to dispose of real property in fee simple by lease,
license, or permit.
Also pursuant to Section 2-114, Hawaii County Code, real property may be sold or leased through
negotiation upon a finding by the council that the public interest demands it.
Your Committee during its discussion of Resolution No. 234-00, made the following amendments:
1. Deleting "to Catherine Morgan" in the title of the resolution.
2. Amending the 5`" Whereas clause as follows: and assume all
costs and risks involving removal..."
3. Adding a 6t" Whereas clause to read "WHEREAS, for all the
foregoing reasons, the public interest demands that the real
property needs to be disposed of through negotiation."
4. Changing the resolved clause to read "...in accordance with
Chapter 2, Article 19, Section [2-ll 1] 2-114 of the Hawaii County
Code that the County of Hawaii authorizes the disposition by
negotiation of the three (3) cottages [to Catherine Morgan].

Your Committee on Finance is in accord with the purpose and intent of Resolution No. 234-00,
as amended to Draft 2, and recommends its adoption.
