Your Committee on Finance, to which was referred Resolution No. 241-00, reports as follows:
Resolution No. 241-00, transmitted by Mayor Stephen K. Yamashiro, via Communication No. 730,
dated March 31, 2000, authorizing the sale of Lot 6 of "Crossroads" situate at Lanihau 1St, North
Kona, Hawaii TMK 3`d/7-5-04:63.
The County of Hawaii has received an offer from Maryl Group, Inc. to purchase in fee simple or to
lease with an option to purchase Lot 6 of the "Crossroads" property. As the County administration
does not have any plans to utilize Lot 6 for any of its programs, it has proposed this sale.
Pursuant to Section 2-1 1 1, Hawaii County Code, the council may, by resolution, as approved by a
majority of its members, direct the finance director to dispose of real property in fee simple by lease,
license, or permit.
Your Committee during its discussion of Resolution No. 241-00, amended the measure to include
new language as follows:
"WHEREAS, on June 19, 1998, the Council adopted Resolution No. 279-98, requesting the
mayor to negotiate with SoBay Hawaii, Inc., to acquire the beachfront parcel at Wai`aha,
North Kona, Hawaii, identified by TMK: 7-5-18:20 for public purposes; and
WHEREAS, on March 22, 2000, the Council adopted Bill 198, which amended the Capital
Budget in order to acquire the Wai`aha Bay property identified as TMK: 7-5-18:20.
BE IT FURTHER RESOLVED that the proceeds derived from the sale of the subject
property (TMK: 7-5-04:63) shall be used solely for projects in the North Kona district, with
first priority given to the acquisition of lands of Wai`aha, per Ordinance No. 00-36 (Bill 198),
unless otherwise directed by the Council."

Your Committee on Finance is in accord with the purpose and intent of Resolution No. 241-00, as
amended to Draft 2, and recommends its adoption.
