KENOI TO REQUEST GOVERNOR NEIL ABERCROMBIE TO RELEASE THE $18.1 MILLION ALLOTMENT FROM THE GENERAL OBLIGATION BOND FUND FOR THE KA`U HIGH AND PAHALA ELEMENTARY SCHOOL GYMNASIUM /CIVIL DEFENSE SHELTER. WHEREAS, the existing Ka`u High and Pahala Elementary School gymnasium, originally constructed around 1936, is not an adequate civil defense shelter and is far too small for the needs of Ka`u High and Pahala Elementary School or the surrounding community; and WHEREAS, due to significant risk of volcanic eruption, lava flow, increased vog emission, earthquake, tsunami and flash flooding, the Ka`u High and Pahala Elementary School is in critical need of a new gymnasium and civil defense shelter; and WHEREAS, on November 10, 2010, Mayor William P. Kenoi submitted a written request to Governor Linda Lingle asking that the State release the $18.1 million authorized expenditure for the design, construction, and equipment for the Ka`u High and Pahala Elementary School gymnasium; and WHEREAS, the State has not released the $18.1 million and the need for these funds is critical to the health, safety and welfare of the Ka`u and Pahala community; and WHEREAS, a copy of the November 10, 2010, letter to Governor Linda Lingle requesting release of the appropriated funds pursuant to the expenditure authorized under Act 162 of the Session Laws of Hawaii (SLH) 2009, as amended by Act 180 SLH 2010, Section 62, Item 5- K011.02, is attached hereto as Exhibit "A" and incorporated herein by reference; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the Mayor is urged to submit a follow -up request to Governor Neil Abercrombie for release of the $18.1 million expenditure allocated by the state to design, construct and purchase necessary equipment for the Ka`u High and Pahala Elementary School gymnasium/civil defense shelter. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Honorable Mayor William P. Kenoi, the Director of the Department of Parks and Recreation, the Director of the Department of Finance, the Director of the Planning Department, the Administrator of the Hawaii County Civil Defense Agency, the Chairperson of the State Department of Education, the Honorable Senator Gilbert Kahele, the Honorable Representative Robert Herkes, the Director of the American Red Cross — East Hawaii Branch, the Principal of the Ka`u High and Pahala Elementary School and the Honorable Mazie K.
