Re: Warranty Deeds--Richard U. Shinto

We are transmitting for the Council's review and consideration
for acceptance a Resolution authorizing the acceptance of donation
of real property from Richard U. Shinto, along with copies of the
Warranty Deeds.
Upon acceptance of the above deeds, please send notification
of such acceptance to the undersigned and we will forward the
documents to the Bureau of Conveyances for recording.

WARRANTY DEED
KNOW ALL MEN BY THESE PRESENTS:
That RICHARD U. SHINTO, husband of Setsuko Louise Shinto ,
whose residence and mailing address is 1225 Bluff Road,
Montebello, California 90640, hereinafter called the 'Grantor, "
for and in consideration of the sum of ONE DOLLAR ($1.00) to him
paid by the COUNTY OF HAWAII, a municipal corporation of the State
of Hawaii, whose principal place of business and mailing address
is 25 Aupuni Street, Hilo, County and State of Hawaii 96720,
hereinafter called the "Grantee, ' the receipt of which is hereby
acknowledged, does hereby grant, bargain, sell and convey unto the
Grantee, its successors and assigns, in fee simple, forever, the
real property hereinbelow described:
Lot No. Twenty (22) , Block No. One Hundred Six (106) ,
situate in the County and State of Hawaii, as shown on the
map of HAWAIIAN OCEAN VIEW ESTATES, duly recorded in the
Bureau of Conveyances of the State of Hawaii as File Plan
No. 787, in Liber 4255, at Pages 474-476.
TOGETHER WITH an undivided 1/11,500th fee simple interest
in and to all roadways located within the above-mentioned
Subdivision, together with a perpetual non-exclusive
easement-of-way in common with all other owners from time to
time of lands therein, in, over, under and across all of said
roadways, for all ingress, egress and utility purposes;
PROVIDED, HOWEVER, in the event it shall at any future time
be deemed desirable by the COMMITTEE having control of the
Road Maintenance Escrow Fund heretofore established to convey
the said roadways or any portion of them to any proper
governmental authority which shall undertake the maintenance
of said roadways, the ownership and easements herein set
forth shall, to the extent necessary, be forthwith
terminated, and the Grantee herein does hereby irrevocably
appoint said COMMITTEE and its successors its
attorney-in-fact to make such conveyances.
BEING THE SAME PREMISES conveyed to the Grantor herein by
Deed of Grayco Land Escrow, Ltd. , dated June 22, 1972, and
recorded in the Bureau of Conveyances of the State of Hawaii
in Liber 8436, at Page 438-439.
EXCEPTING AND RESERVING to the State of Hawaii all mineral
or metallic mines of every description.
TO HAVE AND TO HOLD the same, together with all rights,
improvements, easements, privileges and appurtenances thereunto
belonging or in anywise appertaining, or held and enjoyed
therewith, unto the Grantee, its successors and assigns, in fee
simple, forever.
AND the Grantor, for himself, his heirs, personal
representatives and assigns, does hereby covenant with the
Grantee, its successors and assigns, that he is seised in fee
simple of the above-described premises; that the same is free and
clear of and from all encumbrances, except as aforesaid; that he

has good right to sell and convey the same as aforesaid; and that
he will, and his heirs, personal representatives and assigns
shall, WARRANT AND DEFEND the same unto the Grantee, its
successors and assigns, forever, against the lawful claims and
demands of all persons whomsoever.
IN WITNESS WHEREOF, the saidGrantorhas hereunto set his
