Your Committee on Finance, to which was referred Resolution No. 254-OQ, reports as follows:
Resolution No. 254-00, transmitted jointly with Bill No. 253 by Finance Director Harry Takahashi, via
Communication No. 770, dated May 1, 2000, authorizes the County of Hawaii to enter into an
agreement with the State Department of Attorney General Crime Prevention and Justice Assistance
Division for a Clandestine Drug Response Program grant.
This grant is provided to enhance the ability of the Hawaii County Police Department to conduct
aggressive, comprehensive and coordinated law enforcement activities to detect, identify, access, and
counter or neutralize clandestine drug manufacturing laboratories by training officers and purchasing the
proper equipment.
The Hawaii County Police Department is ready and willing to proceed with its obligations under the
Clandestine Drug Lab Response Program.
Pursuant to Section 46-7, Hawaii Revised Statutes, county departments must obtain the consent of the
council to enter into agreements with the federal or state governments respecting action to be taken
pursuant to any of the powers granted by law to furnish, expend and receive any funds or other
assistance in connection with projects being or to be undertaken pursuant to those powers.
Due to the recent deferral of a similar grant, some members of Your Committee expressed concerns as
to the validity of the certification to accept grant monies as entered into by the current Police Chief.
However, Your Committee voted in favor of this Resolution, and its accompanying Bill, with the
understanding that an official opinion from the Department of Justice will be requested.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 254-00 and
recommends its adoption.
