REPORT OF THE <br /> COMMITTEE ON FINANCE <br /> DATE: July 6, 2000 Re: Comm. No. 749/Res. No. 246-00 <br /> PLACE: Council Chambers <br /> TIME: 10:45 A.M. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Finance, to which was referred Resolution No. 246-00, reports as follows: <br /> Resolution No. 246-00, transmitted by Finance Director Harry Takahashi, via Communication <br /> No. 749, dated April 17, 2000, authorizes the County of Hawaii to enter into an agreement with <br /> the United States of America for a Marijuana Eradication grant. <br /> The United States of America through the Department of Justice, Drug Enforcement <br /> Administration, is desirous of providing funding for expenses incurred to investigate, eradicate <br /> and suppress the cultivation and trafficking of controlled substances. <br /> The Hawaii County Police Deparhnent is ready and willing to proceed with its obligations under <br /> the Marijuana Eradication Program. <br /> Originally heard on May 2, 2000, this measure was defened to allow council to gather more <br /> information regarding the State's medical marijuana legislation. Also due to the recent deferral <br /> of a similar grant, some members of Your Committee expressed concerns as to the validity of the <br /> certification to accept grant monies as entered into by the current Police Chief. <br /> Some members of Your Committee expressed concern that the grant does not include a provision <br /> <br /> that indemnifies the council in impeachment matters. It was Teamed that the Police Department <br /> and the Corporation Counsel aze seeking an insurance policy, as suggested by the Drug <br /> Enforcement Administration, that could cover this circumstance. <br /> Pursuant to Section 46-7, Hawaii Revised Statutes, county departments must obtain the consent <br /> of the council to enter into agreement with the federal or state governments respecting action to <br /> <br /> betaken pursuant to any of the powers granted bylaw to furnish, expend and receive any funds <br /> or other assistance in connection with projects being or to be undertaken pursuant to those <br /> <br /> powers. <br /> For informational purposes, Mr. James Y.
