STATE OF HAWAII BILL NO. 51 AN ORDINANCE AMENDING CHAPTER 18, ARTICLE 4, OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO PUBLIC TRANSIT SYSTEM, ISLAND -WIDE FARE STRUCTURE. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. To amend Article 4, Public Transit System, Island -Wide Fare Structure, of the Hawaii County Code. The amendment of this article will establish a $1.00 cash fare for riders of the Hele-On bus system. Children under the age of five, senior citizens, individuals with disabilities and students will be able to ride free of charge; and for all other riders, a discount of twenty-five percent will be provided on a fare pre -payment program utilizing bus passes or bus tickets. SECTION 2. Chapter 18, article 4, Hawaii County Code 1983 (2005 Edition, as amended), is amended to read as follows: "Article 4. Public Transit System. Division 1. Island -Wide Fare Structure. A driver of any mass transit bus owned, maintained and operated by the County shall charge $1 for each piece of baggage, including large backpacks, except that any small bag such as a train case, handbag, briefcase, or a package that can be carried on the lap of the passenger and within the passenger's respective seat shall be conveyed without charge. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 4. If any provision of this ordinance, or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5.
