Ford, Council Member SUBJECT: Proposed Amendments to Resolution No. 65 -11; Amending the Rules of Procedure and Organization of the Council of the County of Hawai`i by Adding a New Rule No. 32. Public Hearings. Please find attached proposed amendments to Resolution No. 65 -11 as set forth in "Exhibit A” attached hereto and incorporated herein by reference. The proposed amendments are illustrated below in Ramseyer format with respect to the contents of Resolution No. 65 -11, (material to be deleted is bracketed and stricken through, material to be added is underlined). Of .] The time, date, and place of any public hearing will be determined by the Committee or Council Chairperson or by a majority vote of the Committee or Council if there is a motion to have the Committee or Council determine the specific criteria 2. Paragraph 4: "The public hearing should be held in the area or district most affected_ (unless]If the matter affects the entire island, then it may be heard in any area or district on the island. [er]If it impacts multiple districts, then it may be heard in any one of the impacted districts as determined by the committee or council chairperson." To PrwsF►a1.41 Csw041 Hawaii County is an Equal Opportunity Provider and Employer Ref, Date MAY - 4 ;2011 _ A RESOLUTION TO AMEND THE RULES OF PROCEDURE AND ORGANIZATION OF THE COUNCIL OF THE COUNTY OF HAWAII BY ADDING A NEW RULE NO. 32, PUBLIC HEARINGS. WHEREAS, the Rules of Procedure and Organization of the Council of the County of Hawai`i ( "the Rules ") govern the affairs of the Council of the County of Hawai`i ( "Council "); and WHEREAS, the Rules were duly adopted by Resolution No. 04 -10 on December 6, 2010 and previously amended by Resolution No. 25 -11; and WHEREAS, the Rules were most recently amended by Resolution No. 30 -11, duly adopted on February 16, 2011; and WHEREAS, the Council wishes to further amend the Rules to facilitate effective and efficient procedure and organization of the legislative branch of the County of Hawaii; and WHEREAS, the Council wishes to amend its rules by adding a new Rule No. 32, Public Hearings, to set a thirty -day maximum time period for a public hearing, define how the time, place and location shall be selected; and WHEREAS, during the budget cycle, amendments to the budget shall be heard within the thirty -day time period, but no later than May 31 of the current fiscal year; and WHEREAS, adding a new Rule No. 32, Public Hearing is set forth in "Exhibit A" attached hereto and incorporated herein by reference; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Rules of Procedure and Organization of the Council of the County of Hawai`i are hereby amended as indicated in the attached "Exhibit A." BE IT FINALLY RESOLVED that the County Clerk shall provide to all appropriate parties those pages of the Rules that have been amended, to replace those pages that have been made obsolete by the adoption of this resolution. "Exhibit A" RULE NO. 32 PUBLIC HEARINGS 1. Any request for a public hearing requires an affirmative vote of at least three standing committee or council members. 2. All public hearings shall be held within thirty days of the affirmative vote for a public hearing. 3. The time, date, and place of any public hearing will be determined by the Committee or Council Chairperson or by a majority vote of the Committee or Council if there is a motion to have the Committee or Council determine the specific criteria. 4. The public hearing should be held in the area or district most affected. If the matter affects the entire island, then it may be heard in any area or district on the island. If it impacts multiple districts, then it may be heard in any one of the impacted districts as determined by the committee or council chairperson. 5. Video - conferencing may be used if it is available. 6. A call for a public hearing regarding any budget amendment to the proposed operations or capital improvement project budgets shall be completed no later than May 31 of the current fiscal year.
