RESOLUTION NO. 7 3 11
A RESOLUTION AUTHORIZING ACCEPTANCE, BY THE COUNTY OF HAWAII
DEPARTMENT OF PUBLIC WORKS, OF SEVEN (7) AUTOMATED EXTERNAL
DEFIBRILLATORS FOR THE WEST HAWAI'I CIVIC CENTER.
WHEREAS, an Automated External Defibrillator ( "AED ") is a computerized medical
device that can check a person's heart rhythm, recognize a rhythm that requires a shock, and
advise a rescuer when a shock is needed; and
WHEREAS, Public Access to Defibrillation ( "PAD ") means making AEDs available in
public and /or private places where large numbers of people gather; and
WHEREAS, on February 5, 2011, Mayor William P. Kenoi's Executive Assistant,
Bobby Command, survived a cardiac episode on Oahu after Chaminade University students
flagged down an ambulance and the Emergency Technicians restarted Bobby Command's heart
using an AED; and
WHEREAS, the February 5, 2011, cardiac episode on Oahu demonstrates the
importance of AEDs in public places, and
WHEREAS, K. Taniguchi, Ltd. would like to donate seven (7) AEDs, to be placed at the
West Hawai`i Civic Center, that will benefit the community with a PAD program; and
WHEREAS, the seven (7) AEDs have a total estimated value of $10,000; and
WHEREAS, Article XIII, Section 13 -12, of the Hawai`i County Charter provides that
the Hawai`i County Council, on behalf of the County of Hawai`i, may accept gifts or donations
of personal property; and
WHEREAS, the County of Hawai`i, Department of Public Works recommends
acceptance of the donation from K. Taniguchi, Ltd. of seven (7) AEDs and that K. Taniguchi,
Ltd. be released from any and all liability that may arise with respect to the donation of the seven
(7) AEDs; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in
accordance with Article XIII, Section 13 -12, of the Hawai`i County Charter, the Council of the
County of Hawai`i authorizes the County of Hawai`i, Department of Public Works to accept the
donation of seven (7) AEDs for the West Hawai`i Civic Center.
BE IT FURTHER RESOLVED that an appropriate "Release, Hold Harmless and
Indemnity Agreement," releasing K. Taniguchi, Ltd. from any and all liability that may arise
with respect to the generous donation of the seven (7) AEDs be executed.
BE IT FINALLY RESOLVED that the Clerk of the County of Hawai`i is directed to
transmit copies of this Resolution to the Honorable Mayor William P. Kenoi; the Director of the
Department of Public Works; the Director of the Department of Finance; the Office of the
Corporation Counsel; and K. Taniguchi Ltd., along with a letter acknowledging this generous
donation.
